Meeting Minutes – May 17, 2018                                

Members present: Peter Craine, Norm Anderson, Kate Gervais, Butch Nadeau.  Glenn Kauppila present at 6:36 PM
Members absent: none
Guests: None                    

Meeting was called to order by Peter Craine at 6:32 PM.

Meeting Minutes

Spelling of Intervale Road needed to be corrected.  
Norm moved to accept the minutes from the April 19th meeting with spelling correction.

Discussion
Ridge Road site – see April 19th minutes:
Peter reported that he visited the Building Inspector with Brian Kennedy, guest from April 5th Earthworks Board meeting.  Peter reported that he spoke with Clea Blair regarding Clea’s operation on Ridge Road.  Clea will start using calcium chloride to knock down the dust.  Earthworks board does not have the authority to shut down the operation.  Margaret had emailed Peter with her concerns about same, and he advised that the current by-law does not apply in these circumstances.  Peter advised that he contacted the DEP, who responded with the Air and Noise statute.  They are willing to brainstorm with Peter, but, again, the Earthworks Board is not responsible for this particular issue.  Peter mentioned that the same applied to Clea’s Main Street site; It appears to be stockpiled soil, and has the same applicability as the site on Ridge Road.  Norm believes the Building Inspector can pursue the issue as a zoning violation.

Mission Statement:
Peter will make a final small correction, and submit to Anita to go on the town website.

Application:
Peter found the original Earth Removal Permit Application, and created a new form therefrom, with added section for Approval/ Denial.  Norm asked whether a public hearing is required for both initial permit and renewal, Peter advised that it should be needed for permit only.  Glenn noticed that one of the original versions of the application required bonding.  Kate suggested that the form include permissible days and hours of operation.  Norm suggested that the board change the petitioner to allow an individual or entity to apply.  He also mentioned that requiring a list of abutters is no longer appropriate or necessary, and suggested that section be changed to a check box to indicate whether the applicant had obtained a certified abutters list.  Norm questioned the wording of the permission section, and asked whether permits will be conditions.  Peter advised that the form is in a draft phase, and that permits will be conditioned.
