Hearings
Brice-Lemon Estates
Hearing continued from June 3, 2014. Hearing re-opened at 7:21 PM. Carl Hultgren from Quinn Engineering came to go over their review with the Board. Carl stated that EcoTec also looked into the plans and delineation. Some of the revisions and suggestions that Quinn has made are already being implemented because they are the same recommendations that Mr. Blair received from the Planning Board review. Julian walked with Art Allen from EcoTec and they went to each flag and only a few flags were modified very minimally. Julian is doing a new plan of the flags for reference, and any new flag had a letter added to it, for example 14A. Julian estimates that 10 flags were added. EcoTec sent a memo that highlights where flags were added or modified. Art suggested that the 2
existing crossings be restored and less disruption where the replication will be. The total area of proposed disturbance is 3,188 square feet. The total area of proposed replication is 5,286 square feet. Julian thinks it would be fairly easy to restore the existing crossings but will talk to Mr. Blair about it. Joe asked if there could be footnotes added on the plans to bring attention to them. Julian has no problem with that. The Superseding Order of Conditions had no filling to 3,000 for the new filing and Carl thinks that justification for the change should be given for documentation purposes. Julian said the reasons are to give more Open Space and to get rid of the bridges. Joe asked if MEPA review would be triggered and Carl said yes. They are going to get a modification of the current certification from MEPA. They will need to get a variance according to Jeff Lacy.
There are 3 non-continuous streams on-site and there is 1 continuous stream in the wetlands. They were asked to rotate the basin. Carl said that an Army Corp of Engineer permit will be needed as well. They have 2 stream crossings and will have to do plans to reflect the proper criteria.
Carl asked if we should review the phasing, but Joe said that we are to approve the whole plan, not parts, so phasing is irrelevant. Carl recommended that a professional oversee the work and to make sure the replication work is completed. Julian agrees that this should be a condition on the Order and is reasonable.
Joe would like them to mark on the plans where they are using waddles and where they are going to use hay bales and to specify the erosion control measures they plan to use.
There is a lot of information to digest from Quinn Engineering and we are also waiting for updated drawings. Julian stated he is hoping to have the drawings complete for the next meeting. Chris Warrington asked if we would cancel the next hearing if the applicant wasn’t ready. Joe said that they still have to be here to be continued, but they can continue the hearing if they need to as long as the board agrees. Eric said that we have not had a representative in the past and have continued hearings. Joe said for this particular project, due to the high chance of appeal, he would like the applicant to physically be here to continue if needed. Julian formally requested on behalf of the applicant that the hearing be continued to July 1st at 7:15 PM so that they could get
revised plans drawn up for the Board. Motion to continue made by Scott, seconded by Shawn; vote unanimous at 7:56 PM.
Discussions
J. M. Soucy Contracting, Lots 105 & 106, Maple Avenue
Maryann delineated the vernal pool in the area on Maple Avenue by Lots 105 & 106 which is on the left side of the driveway.
Maple Avenue replication
Shawn had asked if there was replication that was supposed to be done in the area. Joe said yes, and it has been completed.
Emerald Road
Joe received an email from a concerned resident that a landscape company from out of town is disturbing wetlands and they left mud all over the road on Emerald Road down near the pond. We have had dealings with this company in the past for the same issue.
Takala Pond
The environmental police called Joe and said that it appears the Beaver Dam is being destroyed. Joe told him that he had also heard that the culvert was clogged, so Gary cleaned it out. Joe also received a resident’s concern for the beavers.
