Site walk is scheduled for April 12, 2014 at 9:00 AM, and meeting at Charnock Hill Road.  Hearing scheduled for April 15, 2014 at 8:00 PM.

Julian Votruba, Brice-Lemon Estates
There is currently a Superseding Order of Conditions in place for Brice-Lemon Estates.  The plans were approved with bridges in place.   There is now a different proposed plan; because this is more than a simple modification of the original, approved plans, they are going to refile a Notice of Intent.  When they originally did this, the major issue was the endangered species that were in the area.  There is a new design, and the endangered species is no longer an issue.  They have taken the part of the subdivision that was in the sensitive area and moved them.  The cost of the original construction outweighed the benefits which is one reason things have changed.  There were 3 crossings before, and there are still 3 crossings, but they are now in different areas.  If the new plans are not approved they will use the original plans for the project.

The sewer will be a forced main line to the sewage on Maple Avenue and there will be no tying into the pipes.  The forced main plan has already been approved.  There will be a couple of areas that they will have to protect with hay bales and silt fencing when doing the lines.

The subdivision will be broken down into phases starting with the Charnock Hill area as Phase 1.  The Planning Board wants the crossings ironed out and then to go back to them, so they are coming in front of us first to get the Crossings approved before going to the Planning Board because they are trying to avoid bridges.  Joe asked about the foundation and Julian said they will be Clea’s standard size foundations.  There won’t be a lot of fill brought into the project.  Hay bales and silt fencing are currently in place but Julian said there will be more protection put in place.   He will bring the erosion control plans to the hearing.  Julian went over the plans with Jeff Lacy (DCR) who is happier with these plans.  His only concern is there is an unregulated brook in the area.   Our focus will be on the 3 crossings and to verify where the wetlands are.  They will replicate the wetlands right up against the walls to the crossings.  The 1st crossing will be by Charnock Hill and will be a culvert pipe and retaining wall.  The 2nd crossing is very narrow and will be another culvert pipe and retaining wall.  The 3rd crossing has a ravine in the area.

There is currently logging in the area.  Robin wanted the Board to know that there appeared to be filling being done today.  She was very concerned because of the cutting up there, and there are no permits for the cutting.  Joe said that he spoke to the State Forester about this area and the State Forester stated there is no permit necessary for the area.  Rebecca was there today and took pictures from the road of the area.  She believes the fill was being done only in the beginning area and not in further.

Site Walk – The complete site walk may take up to 2 hours.  It was questioned whether the public can attend the site walk. Julian does not want to give permission without speaking to the landowner first, so Joe will call Mr. Blair and ask whether he will allow the public on the property during the site walk.  Eric thinks we should get an expert to help with such a large area.  Joe said he would like to see the area first and have questions ready, but agrees an expert will most likely be needed.  Scott also agrees that the site walk should be done and any questions the Board has should be drawn up prior to getting an expert. Julian said the wetland line has not changed since the current Order of Conditions.  The wetland line will be the same.  The site walk will be Saturday, August 12, 2014 at 9:00 AM meeting at Charnock Hill Road, and the hearing will be Tuesday, April 15, 2014 at 8:00 PM.
