Hearing opened at 7:25 PM – Request for Notice of Intent, Lussier Enterprises, Lot 1, Pleasantdale Road
The board reviewed the map. It is an estate lot with 50’ entrance. The closest point is 15’ from the flags. It will be built without a garage. According to the map, it seems it’s more like 20’+ away. A broker is actively trying to sell the land. Everything is away from the wetlands. Joe asked if there were any questions and there were none. Motion to close hearing made by Harry, seconded by Mark; vote unanimous at 7:31 PM.
Discussions
Darren Ross & Chris Senecal from the Town Soccer League
They are interested in leasing Sycamore Drive property for soccer fields. They wouldn’t be putting up permanent buildings but maybe a shed with a lawnmower and portable toilets. Joe told them they would have to define passive recreation. Joe asked if they could have a schematic drawn up. They are just trying to look for an easily accessible place for more soccer fields and just wanted to touch base with us and figure out a way to not make the town liable. We need to figure out what “passive recreation” means and how to work it. They are willing to work with us to get it fixed. Stephanie’s only issue was the liability and they will not ask the town to pay. They will lease the land and will maintain it. Joe told them we are held liable.
Chapter 44B Section 2 has the definition of “active or passive recreational use” and it states that “non-commercial youth or adult sports is authorized” per a letter from the state to the town of West Dennis that was found online. More research will be needed. They will be here on the next meeting to discuss this further. They will also be looking into this on their end to see if they know any other league’s that have done this.
