April 26, 2010 – prior to Special Town Meeting

Present: Leroy “Skip” Clark – Chairman, Joseph R. Becker – Clerk, Sheila H. Dibb. Cherilyn A. Bulger – Vice Chairman arrived late.
Discussion began on the letters received from the police chief and whether the matter should be discussed in executive session and /or referred to legal. Chief Baril was invited to give the Board an overview of the letters presented.
Per Chief Baril – ethical question because the School Committee votes and deals with a budget (same funds) as the police department ‘competes’ for. Some discussion on Section 4.16 of the Rutland Police Department rules & regulations particularly with the word “partisan” in section 4.16. The feeling is if in Section 4.16 the word “partisan” can be interpreted, then the issue could be potentially resolved. The Chief further stated that the local union does not agree with Officer Marino running and will not pursue it as a matter of union business.
Decision of the Board was to have Attorney Jenkins interpret Section 4.16. Secondary / separate issue to deal with any other personnel matters separately and in executive session as necessary.
Next steps – further discussion to take place on Monday, May 3, 2010 at the regular meeting and police chief agrees that the officer will remain on active duty until a decision is made.
Mrs. Dibb moved to adjourn. Mr. Becker seconded. Vote unanimous. Meeting adjourned at 6:34 p.m.
