Variance for relief from front lot setback requirements at 16 Pine Hill Road



Minutes and Decision

        The Princeton Zoning Board of Appeals held a public hearing at the Town Hall on Thursday, June 1, 2017 at 7:00 PM to hear a petition for a dimensional variance from Paulette Magaw.  Her property is located at 16 Pine Hill Road, Princeton, Massachusetts and is on Assessors map #4, Lot 42-E.

The petitioner sought a variance, pursuant to M.G.L. Chapter 40A, sec. 10 and Section VIII, subsection 2(E) of the Princeton Zoning By-Laws, for relief from front lot setback requirements (Section VI, subsection 1(D) to construct a covered porch which would extend, at its corner, twelve (12) feet into the minimum fifty (50) foot setback.
Board members present were Chairman John Puricelli, Jesse Weeks, and alternate Larry Greene, Jr.  The Chairman opened the hearing at 7:00 PM, explained the procedure for a public hearing, and read the public hearing notice.

The petitioner was not present but was represented by her brother-in-law, James Cheverie. Mr. Cheverie described the property as a single-story home with a detached garage. The front corner of the house is approximately 46 ft. from the street right of way  --  Mr. Cheverie had done a rough calculation.  The petitioner seeks to construct a covered, open porch, 8 ft. in depth, which would be about 38 ft. from the closest point of the street right of way -- the mid-point of the front property line angles sharply into the lot as it follows a corner on Pine Hill Road.  

No abutters or other members of the public were in attendance.

At 7:20 PM the Board began deliberations.  The Board voted unanimously to grant the petition as a de minimus departure from the Zoning By-Laws.
         Appeals, if any, should be made pursuant to Section 17, of the Massachusetts Zoning Act, Chapter 40A and shall be filed within twenty (20) days after the date of the filing of this decision with the Town Clerk.
