41A Main St.

Minutes and Decision

        The Princeton Zoning Board of Appeals held a Public Hearing on November 7, 2013 at 7:00 PM in the Town Hall Annex to consider the petition of Kevin and Randi Chartrand, owners of the subject property at 41A Main Street, for a variance pursuant to Section VIII. 2(E) of the Town of Princeton Zoning By-Laws.  In particular, the petitioner sought zoning relief from Section VI. 1(D) to add an attached breezeway and two-car garage less than 50 feet from a property line where it borders the street right of way.

        Board members present at the hearing were Chairman John Puricelli, Henry Beth, and Walter Kuklinski.

        Chairman Puricelli explained the three phases of the public hearing.  The petitioners would have an opportunity to present their case, followed by a period of public comment.  Finally, the members of the Board would discuss the petition and make a decision.

        The petitioners, Kevin and Randi Chartrand, were present.  William Pybas, the contractor for the proposed project explained that the petitioners sought to construct a breezeway and two-car garage that would be connected to the existing single family home on the lot.  The garage would be 39 feet from the front property line.  The existing house conforms to all setback requirements.  Both Mr. Pybas and the petitioners discussed certain features on the lot, including the location of the septic system, a propane tank, and a well, which were taken into account in the project design.  They further noted that the lot is bisected by a paved driveway, which is also a right-of-way for a lot to the rear of the property in question.    

        At 7:40 PM the Chairman closed the petitioner’s portion of the hearing.  Charles Lord of 38 Main Street spoke in support of the project.  

        At 7:55 PM the Board closed the public comment portion of the meeting and began discussion of the petition.  After deliberation, Chairman Puricelli moved for a vote.  The motion was seconded, following which the Board denied the issuance of a variance (one member in favor and two opposing).

        The Board makes the following findings of fact and law:

  • The existing home at 41A Main St. is a conforming structure.
  • The proposed extension to the existing home, a breezeway and two-car garage, would be less than 50 feet from the boundary line bordering the right of way of Main St.
  • The petitioners presented no relevant evidence that the soil conditions, shape or topography of the property at 41A Main St., or the existing home at that location, especially affected that property or existing home but not other land or structures in the applicable zoning district.  
  • The petitioners presented no relevant evidence that a literal enforcement of the Zoning By-Laws would involve substantial hardship, financial or otherwise.

Appeals, if any, should be made pursuant to Section 17, of the Massachusetts Zoning Act, Chapter 40A and shall be filed within twenty (20) days after the date of the filing of this decision with the Town Clerk.
