LIST OF TOPICS TO BE DISCUSSED
  • Review and approval on minutes of 12/17
  • Townsend’s visit to see new buildings, cancelled due to scheduling, will work to reschedule
  • Review JWA response to FSC letter of 12/21
  • Review of OSHA Standards document and references from Chief Bennet
  • Review and approve next round of question and answers, #9 and letter from Chief Bennet
  • Opportunity for public questions and input
Action items:
  • RM & NC, to compile lists of questions and answers. To be reviewed at regular meetings and then posted, ongoing
  • RC to follow up with NN on questions:
  • Please point us to the State regulations for doing a Design Build process, as opposed to the traditional Design, Bid, Build process? This process is called “Construction Management at Risk”. It is for projects of $5M+ see below, more details to be discussed at meeting.
  • Is there anyone who is qualified to serve as Owners Project Manager involved with the Town currently? No, there is not.
  • Who would be a best source of information on doing a sale & leaseback for the facility? From the research on this, there appears to be little benefit.
  • RC to follow up with SM on question:
  • Please clarify the source for the requirements for 3 holding cells, not just one. Can you point me to the documentation of this requirement?
  • RM to contact CMRPC, what can they do to help?
  • Selectboard & Advisory Committee, please provide financial context for this project with all the other projects and expenses going forward.

FSC II Follow-up
  • NN & SB to do title search for PC site. In progress, scheduled for completion in mid-Feb.
  • Mass Development money is to bring private money in for project development and job creation, does not appear to apply to this project.
  • NN, Design/build in the public construction space is called CM At-Risk. https://www.mass.gov/how-to/apply-to-use-cm-at-risk
Under M.G.L. c. 149A, § 4, the OIG will issue a Notice to Proceed when the public agency has demonstrated that:
  • The public agency has authorization from its governing body to enter into a contract with a construction management at risk firm.~ The authorization shall include the results of any public vote if applicable.
  • The public agency has the capacity, a plan and procedures in place and approved of by the governing body, where appropriate, to effectively procure and manage construction management at-risk services for the specific project and has retained the services of a qualified owner's project manager.
  • The public agency has in place procedures to ensure fairness in competition, evaluation and reporting of results at every stage in the procurement process.
  • The building project has an estimated construction value of $5,000,000 or more.
  • The public agency has determined that the use of construction management at risk services is appropriate for the building project and states in writing the reasons for the determination.
  • The public agency has procured the services of a designer. [M.G.L. c. 149A, § 3]
  • NN, The Town does not have anyone currently on staff who would be qualified to be an Owners Project Manager. We would most likely need to hire such a person after a Town Meeting, they would manage the plans and bidding as well as the construction project management.
  • NN, Who would be a best source of information on doing a sale & leaseback for the facility? Research into what other Towns have done and legal opinions would suggest that this would provide no benefit and add significant complexity.
  • Selectboard & Advisory Committee, what is being done to minimize spending across the board to minimize the tax rate impact of the new Public Safety Building?
  • Selectboard, what are the required outcomes for the FSC II to prepare the Town to receive the Bond Bill money? The Town should spend no money on JWA or others until this is clear.
  • Selectboard has voted to extend the terms of the members of the FSC Phase II through May 31, 2019 with additional extensions as required.
