March 1, 2011
CALL TO ORDER/Pledge of Allegiance
Chairperson Wendy Sanborn called the meeting to order at 6:00PM with Selectmen Erland Torrey, Larry Moreau and Lester Stevens present. Selectman Bolduc arrived shortly after the first hearing began. The Town Manager was also present.
PUBLIC HEARINGS
Fee Schedule
Selectman Moreau moved to open the public hearing on the proposed changes to the Fee Schedule. Selectman Stevens seconded the motion. Discussion: None.
Vote: 4-yes 0-no
Discussion: Michelle Arsenault commented on how Poland’s fees compared to surrounding towns and how Poland’s appear to be higher.
Selectman Moreau moved to close the public hearing on the proposed changes to the Fee Schedule. Selectman Stevens seconded the motion. Discussion: None.

Selectman Moreau moved that the proposed changes to the Fee Schedule be adopted as presented with an immediate effective date. Selectman Bolduc seconded the motion. Discussion: None.

General Assistance Ordinance – Adopting MMA Version 2006
Selectman Moreau moved to open the public hearing on the proposed changes to the General Assistance Ordinance. Selectman Torrey seconded the motion. Discussion: None.

Selectman Moreau moved to close the public hearing on the proposed changes to the General Assistance Ordinance. Selectman Bolduc seconded the motion. Discussion: None.

Selectman Moreau moved that the General Assistance Ordinance be included on the April 2, 2011 Annual Town Meeting Warrant. Selectman Torrey seconded the motion. Discussion: The Town Manager will have Rosemary prepare a list of the changes between the 1996 and 2006 versions.

Rental Housing Ordinance
Selectman Moreau moved to open the public hearing on the proposed Rental Housing Ordinance. Selectman Bolduc seconded the motion. Discussion: None.

Discussion: Arthur Dunlap questioned section 2.5B, Heating Facilities Required in Let Dwellings in that he believes the state statute requires the 68 degrees to be year-round.
Selectman Moreau moved to close the public hearing on the proposed Rental Housing Ordinance. Selectman Stevens seconded the motion. Discussion: None.

The manager will look into the question regarding section 2.5B and bring the proposed ordinance back to the Board at the next meeting.
Beach Ordinance
Selectman Moreau moved to open the public hearing on the proposed changes to the Beach Ordinance. Selectman Bolduc seconded the motion. Discussion: None.
Vote: 5-yes 0-no
Discussion: When asked about drop offs it was explained that guardians are required for children under 15 years of age. Violations may result in access to the beach being denied. It was explained that the intent of no bikes was in relation to along the shoreline. Fees are still being worked out and will be decided upon prior to town meeting. The Town is still working with the YMCA regarding their lease. In reference to pets Section 5.6 addresses this issue.
Selectman Moreau moved to close the public hearing on the proposed changes to the Beach Ordinance as presented. Selectman Stevens seconded the motion. Discussion: Selectman Moreau withdrew his motion and the Board agreed to table the item until the meeting of March 15, 2011 when the fees can be presented with the proposed changes to the ordinance.

Recognition of Visitors (A list of visitors who attended the meeting are attached to these minutes.)
Art Berry wanted to discuss with the Board regarding a personal matter and for their willingness to look into his prior written request to the Board. Selectman Moreau stated to Mr. Berry that this type of discussion was out of order for this agenda and that an executive session would need to be scheduled and the town attorney would also need to be consulted. Selectman Stevens suggested an executive session for the second meeting of this month at 6:30pm. The Town Manager would make the necessary arrangements.
Michelle Arsenault – Inquired about the plowing for the state park and the fishing derby, the number of hours worked by the Town Manager, and the term limits stated in the Charter for the Chairperson of the Board. These items will be addressed by the manager.
Reports and Communications
Town Manager’s Report – The Town Manager provided a brief verbal summary of his report for the Board.
- J. Cleveland announced that the due date for the newest grant is September 1, 2011.
- Selectman Moreau spoke to the exemplary character of the Town Manager.
The board took a 5 minute recess at 7:12pm.

Old Business
Lane Cemetery (Information on Abandoned / Gift Cemeteries) – Legal advice is to only maintain the cemetery and to not transfer the ownership. Selectman Moreau moved to strike Article 16 from the town warrant and to assume on going maintenance of Lane Cemetery. Selectman Bolduc seconded the motion. Discussion: None.

Maine Public Employees Retirement Plan (possible warrant article)
Comments:
- Shows precedence;
- Too many variables;
- Do not put on warrant and review next year.
Selectman Moreau moved to strike Article 15 referencing the Maine Public Employees Retirement Plan from the warrant as presented March 1, 2011 and to table issue. Selectman Stevens seconded the motion. Discussion: None.

Interlocal RSU Agreement Legal Update – The consensus of the Board is to move forward on what would be the appropriate process to begin and go through these negotiations. The manager will speak to both attorneys.
New Business
Guest Presentation – Joe Kazar, MMWAC - The manager will schedule Mr. Kazar’s presentation for a future meeting.
Medical Insurance Quotes – Discussion only.
Payables
Selectman Moreau moved to approve the bills payable in the amount of $246,956.47. Selectman Stevens seconded the motion. Discussion: None.
