April 10, 2012
CALL TO ORDER
Meeting was called to order at 7:00 by Chairman Carl Duchette with members James Porter, George Greenwood, Robert Brown, William Willett and Alternate Dawn Dyer present. Code Enforcement Officer Nick Adams and the recording secretary were also present. William Foster was absent with notification.

Bobby and Jacqueline Misenheimer – Formal Shoreland Application: Map 31 Lot 2 Sublot 2A&29A
- Bob and Jacqueline Misenheimer are present
- Member Greenwood makes a motion to approve the application as presented under the condition that the CEO will go to the property and check the side setback. Seconded by Member Willett. Discussion: None

Oldcastle Lawn and Garden – Amendment to Site Plan: Map 2 Lot 4
- Melissa Keifer and Aaron Boone are here to represent Old Castle. They state they are here today because the noise berms never came before the planning board. The DEP has been out to inspect and no violations have been noted. Berm D and C are not connected due to wetlands that they did not want to encroach on. Equipment was placed on top of the berms during building of the berms.
- Ginger Leigh Smith and Gina Karkos who are abutters are present stating the berms don’t work. The noise, to them, is unbearable
- Documentation that noise level does not exceed the state level are included in the packet. CEO visited the abutting properties and states that all information received from the DEP states they are not in violation at the property lines therefore he cannot file a violation. According to CEO this would be a civil issue.
- Mr. Boone states his understanding is that the state takes the average so there could be a spike but DEP measures averages. Every day the facility owners measure the sound when the grinder is running to make sure the levels are within standards. They have tried to mitigate the noise levels by changing to low frequency alarms rather than normal back up alarms.
- Carl any other measures they can take to reduce the noise, answer is not really. Independent study done on the property , didn’t find them out of compliance so no recommendation were given. Take noise on top of the berm and property line on a daily basis. Would like to move raw materials to the middle of the property to get the grinder closer to the center of the area would reduce noise.
