Minutes of Meeting
November 22, 2011

CALL TO ORDER
The meeting was brought to order by Chairman Carl Duchette at 7:00 PM with members George Greenwood, Jim Porter, William Willett, and alternate William Foster present.  Interim Code Enforcement Officer Robert Folsom Sr. and the Recording Secretary were also present.  Member Robert Brown was absent with notice.  Norm Davis was absent without notification.

OLD BUSINESS
Autumn, Inc.: Preliminary Major Subdivision Application – Map 13 Lot 16 & 12
  • Mike Gotto and Brian Merrill are present to represent Wildwood Estates.  Mr. Gotto states that the association documents are not finalized but will be shortly.  Driveways will be closer per Bob Faunces recommendation.  
  • Member Greenwood recused himself due to a working relationship with the client.  
  • Member Porter questions where the mailboxes are going to be located.  Mailboxes have not been put on yet, mailboxes will more than likely be on the end of Jessica Way.  
  • Jessica’s Way has not been accepted as Town Road yet and Mr. Gotto has agreed to speak with Mr. Faunce about buffering on Jessica Way.  Soil tests will be completed November 28, they are still monitoring on the fire pond.  
  • Mr. Faunce recommends curb cuts and association docs before we approve the preliminary application.  
  • Member Willett asks about whether a site visit has to be made, verified the code says MAY not MUST so Chairman Duchette feels that a visit does not have to happen.  
  • Consensus of the board that the preliminary application be approved while moving ahead to the final application.  
  • Motion made by Member Porter to table the approval of the preliminary application while moving ahead to the final application, seconded by Member Willett.  Discussion: NONE
Vote: 4 – YES     0 - NO.  

NEW BUSINESS
None

RECOGNITION OF VISITORS – ITEMS NOT ON THE AGENDA
  • Mr. Farr, community member who wishes to open a Doggy Day Care.  Mr. Farr is questioning why a dog day care would not be a permitted use in the DownTown District.  Mr. Faunce states that a dog day care is a kennel, under our definitions – truly an accessory use to the allowed permitted use then that would be reasonable.  Animals shall not be trained or boarded at a pet store.  Mr. Farr states it would strictly be M-F only during the day time.  Chairman Duchette states that a change in the allowed uses be addressed at Town Meeting for a dog day care to be added as an allowed use in the Downtown district.  This item will be placed on the agenda in a workshop held by the Planning Board.  Board is in consensus.
OTHER BUSINESS
  • Interim CEO Folsom brings up that there was a question brought forward by the DEP whether or not the Board may have been violating a stream protection area, ordinance states one thing but received documentation that it is okay.  Deidre Shneider okayed the project to move ahead.
  • Bob Faunce – Home Occupations; three different types; TYPE A; TYPE B; TYPE C… ordinance need to make table of uses agree with home occupations descriptions.  Spoke with Town Attorney and she stated the provisions are more strict than the table we have to follow the written documents.  Bob states that he feels the ordinance should be changed so that all Home Occupations have CEO review.  Mr. Faunce will provide us with documentation on wording to put forth before the Townspeople at Town meeting for approval.  NEW PAGES FOR CLUC REGARDING HOME OCCUPATIONS will be issued at next meeting.
  • Shaker Hill Village – Will be present at next meeting with complete application

Member Greenwood made a motion to adjourn at 8:02 PM second by Member Porter.  Discussion: None  
Vote:  5 – YES     0-NO
