Mr. Conner called the meeting to order and explained the procedures for the evening.

Mr. Keohan, the Clerk, read the legal advertisement into the record.

The Petitioner, who is seeking a Special Permit per Section 205-42 and Table V to waive side and front setbacks in order to raze an existing shed and construct a detached single-story two-car garage, did not appear.

Mr. Peck motioned to continue Case No. 3644 to October 19, 2011 at 7:30 P.M. Mr. Main seconded.  Agreed unanimously (5-0)

Mr. Bush represented himself. He is seeking a Special Permit per Section 205-40 and Table V to waive the side setback requirements in order to construct a side landing and stairs.

Mr. Bush explained the situation where the owners were flooded out during a storm and to remedy the problem they raised the house seven feet and installed a new septic system. They also raised the side deck next to the kitchen door and added stairs. The stairs interfered with the side setbacks, which was unknown to the owners at the time of the construction.

Public Comment In favor:  Two abutter letters were submitted.

Public Comment:  Barbara Brewster had concerns regarding an abutting easement. The Board suggested she investigate with the Town Engineer.

Mr. Conroy motioned to approve Case No. 3645. Mr. Keohan seconded.  Granted unanimously (5-0).

“Continued” Public Hearing – Case No. 3633

Mr. Keohan recused himself from the hearing.

This public hearing was first convened on June 29, 2011, continued to August 17, 2011 and concluded on October 5, 2011. Attorney Edward T. Angley represented the Petitioner’s who are seeking a Special Permit per Section 205-40 paragraph D5 subject to Environmental Design Conditions for a communication tower and a Special Permit per Section 205-17 paragraph 1 to exceed the height requirements. Attorney Richard M. Serkey of Winokur, Serkey & Rosenberg, P.C. represented the opponents.  The public comment section of the hearing was closed on August 17th.

Attorney Jeffrey T. Angley summarized the applicant’s request and responded to a comment made at the August 17, 2011 hearing from the Board regarding the proximity of the tower to the preserve. Attorney Angley said that the tower as presently sited would be 220 feet from the closest walking trail, well past the 150 feet of the tower. With regards to coverage, Attorney Angley stated that a software program is used to determine if there is adequate coverage in a particular area.  Kevin Delaney, Engineering and Regulatory Compliance Manager for Industrial Tower and Wireless, LLC answered questions relative to potential carriers, the fact being that the applicant is counting letters of support as commitments.  Mr. Delaney clarified the ten foot rule of measuring distances between carriers on a particular tower.
