Zoning Board of Appeals Minutes March 2, 2011
These minutes are not verbatim – they are the secretary’s interpretation of what took place at the meeting – Open Meeting Law – Section III.

Members present:  Peter Conner, David Peck, Michael Main, William Keohan, Edward Conroy, and Ryan Matthews

Members absent:  James Simpson

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing – Case No. 3622

Mr. Keohan, the Clerk, read the legal advertisement into the record.

Mr. Degnan represented himself requesting a Special Permit to waive the side yard setback requirements in order to enclose a screened porch on the existing dwelling, on the existing foundation, to create a bedroom, post facto. Mr. Degnan explained that the work was already in place when he purchased the home.

There was no public comment in favor.

Mr. Joseph Olson, the neighboring abutter, spoke in favor of the project requesting that a privacy fence be installed.

Hearing Closed

Mr. Conroy motioned to approve Case #3622 with one condition.  Mr. Keohan seconded.  Granted unanimously (5-0)

Mr. Keohan read the legal advertisement into the record.

Mr. Keohan then read a letter from Atty. Robert C. Betters dated February 24, 2011, who is representing the petitioner, requesting that the Board of Appeals continue the public hearing scheduled for March 2, 2011 due to a conflict in scheduling.

Mr. Main motioned to continue the hearing to May 4, 2011 at 7:30 p.m. Mr. Peck seconded.  Granted unanimously (5-0)

Informal Hearing – Cases #3586, 3588, and 3589

Sitting:  Mr. Conner, Mr. Peck, Mr. Keohan, Mr. Main, and Mr. Conroy

Mr. Stephen Kotowsky of Webby Engineering Associates, Inc. represented the petitioner who obtained Special Permits to waive the front and side setback requirements in order to rebuild three non-conforming structures.  Mr. Kotowsky presented the Board with revised site plans and addressed each condition of the Special Permits.

Mr. Main motioned to accept the revised plans.  Mr. Peck seconded.  It was unanimously agreed (5-0) that the Conditions have been satisfied

No further business came before the board in open session.
