Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing
#3581 – Robert J & Marjorie Kay
            17 Clyfton Street, Plymouth, MA

Mr. Keohan read the legal advertisement into the record.

Mark Flaherty, Flaherty & Stefani, Inc., representing the petitioner, stated that his clients were vacationing in New Hampshire and a no-show. The petitioner requires relief to waive the side and rear setback requirements to demolish an existing 2-car garage and reconstruct a detached 26’ x 36’ 2-car garage and workshop. The new garage will be constructed more to the right of the old one so it won’t be seen as much from the street and the new workshop would only be used for hobbies and would not be used to conduct a business.

Public Comment: No public comment was offered.

Hearing closed.

Vote:

David Peck made a motion to Grant Case No. 3581 with three conditions as stated.

Michael Main seconded.

Granted unanimously.

#3582 – S/F, LLC

Ryan Matthews recused himself from the case

Mr. Keohan read the legal advertisement into the record.

The petitioner requires relief to extend, alter, construct, reconstruct, enlarge and/or move a pre-existing non-conforming structure in order to create a 15 x 30 foot patio, erect and relocate a sloped riprap wall and reallocate seating for a restaurant. Atty. Richard Cornetta, representing the petitioner, presented an in-depth presentation of the proposed changes with visual displays. This is part of the Village Landing Marketplace, has private parking spaces, and is in the Waterfront Zoning District. A special permit was given and modified in June of 2009 for the rip rap wall. On April 14, 2010 they received unanimous approval from the Design Review Board and The Steering Committee approved it unanimously on April 15, 2010.

Public Comment:

Patricia Aube, Acumen Consultants LLC spoke in favor of the project.

No Public comment in opposition.

Mr. Main made a motion to grant Case No. 3582 with two conditions. Mr. Conroy seconded with conditions.
