Zoning Board of Appeals Minutes April 21, 2010

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing    
#3578 – Todd Christian
           60 Samoset Street

Sitting: Peter Conner, David Peck, Michael Main, Ryan Matthews and Walter Kelley.

Mr. Main read the legal advertisement into the record and the Public Hearing was opened.

Todd Christian presented his request for a special permit per Section 205-48, table V to waive the front and side setback requirements and a Special Permit per Section 205-25 to enlarge a non-conforming structure and use, in order to demolish a pre-existing, non-conforming structure and replace it with a two-story structure within the same footprint.  

Public Comment in favor: None

Public Comment in opposition: None

The Public Hearing was closed.
VOTE:
Walter Kelley moved for the Zoning Board of Appeals to grant Case No. 3578.

Ryan Matthews seconded.

The vote was (4-1) with Peter Conner in opposition.

Edward Conroy arrived during the Public Hearing for Case No. 3578.

#3579 – Eastport Bayside LLC
           31 Caswell Lane

Sitting: Peter Conner, David Peck, Michael Main, Edward Conroy, and Ryan Matthews.

Mr. Main read the legal advertisement into the record and the Public Hearing was opened.

Atty. Edward Angley, Michael Price, Eastport Bayside LLC, and Gerry Preble, Beals and Thomas, Inc., presented a request for modification of Special Permits #1151, 1381, 1604, 1696, 2059, and 3406 and a Special Permit per Section 205-46, C5-5, including a waiver of any dimensional intensity and density requirements necessary, in order to construct four multi-family residential units.

Public Comment in favor: None

Public Comment in opposition: None

General Comments:
Michael Sciog expressed his concerns with any increase to density.
Andrea Melville was concerned with the ongoing maintenance of the existing swale.
The Public Hearing was closed.
VOTE:
David Peck moved for the Zoning Board of Appeals to grant Case No. 3579 with seventeen (17) conditions.

Michael Main seconded.

The vote was unanimous (5-0).  


Public Hearing    
#3580 – E. J. Pontiff, Inc.
           Off Micajah Pond Road and Black Cat Road

Sitting: Peter Conner, David Peck, Michael Main, Edward Conroy and Walter Kelley.

Mr. Main read the legal advertisement into the record and the Public Hearing was opened.

Atty. Edward Angley, Mark Flaherty, Flaherty and Stefani, Inc., presented a request for a Special Permit per Section 205-18, Paragraph B4, F and G, and a Special Permit per Section 205-40, Paragraph D1, subject to Environmental Design Conditions to excavate approximately 434,000 cubic yards of gravel in order to expand an existing cranberry bog.

Public Comment in opposition: None

The Public Hearing was closed.
VOTE:
Michael Main moved for the Zoning Board of Appeals to grant Case No. 3580 with twenty-three (23) conditions.

David Peck seconded.

The vote was unanimous (5-0).  

The meeting adjourned at 9:35 p.m.
