Zoning Board of Appeals Minutes February 24, 2010

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing    
#3573 – Atlantic Properties
           3 & 5 Resnik Road

Sitting: Peter Conner, David Peck, Edward Conroy, Michael Main and William Keohan.

Mr. Keohan read the legal advertisement into the record.

William Shaw, Associated Engineers, presented the request for a special permit subject to EDC for gravel removal in excess of 10 cubic yards and a special permit for buffers on property located at 3 and 5 Resnik Road in order to remove approximately 80,000 cubic yards of gravel in order to prepare for development of an industrial site and an access drive in the Plymouth Industrial Park.   Special permits were previously approved by the Zoning Board of Appeals to construct the PAC-TV building on this site.  The current proposal includes an office building and a warehouse/office building, associated parking, an entrance way off Commerce Way and an entrance way that will open to Resnik Road and Industrial Park Road.

VOTE:

Michael Main made a motion to grant Case No. 3573 with twelve conditions.

Mr. Peck seconded.

Granted unanimously.

INFORMAL MATTER

#3570 – MetroPCS Massachusetts LLC   
          Cedarhill Park Drive

Sitting: Peter Conner, David Peck, Edward Conroy and Ryan Matthews.

The Board reviewed the landscaping plans that were submitted to comply with condition No. 2 of the decision to grant a Special Permit per Section 205-17, Paragraph 11, to exceed the 35’  height requirements in order to install three communication antennas on a new metal pole on property of Timeless Advances LLC, located on Cedarhill Park Drive, and shown as Lot 37A-2 on Plat 55 of the Assessors’ Plans in a GC Zone:

Condition No. 2
The petitioner shall return to the Zoning Board of Appeals with a plan/sketch of the proposed landscaping around the concrete pad. The landscaping plan/sketch shall be submitted for approval at an informal hearing.

Ryan Matthews moved for the Board to approve the landscape plan and accept Condition No. 2 as completed.  

Mr. Conroy seconded.

The vote was unanimous (4-0).

Peter Conner announced that the Board would be entering into executive session to discuss pending litigation and would not be returning to regular session.

The Board adjourned their regular session and entered into executive session
