Zoning Board of Appeals Minutes September 30, 2009

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing  
#3545 – SUNNA LLC   
          9 Long Pond Road

Mr. Main read the legal advertisement into the record.

Attorney Angley, representing the petitioner, referred to the memo written to the Building Commissioner.  The Bylaw does not define highways or automobiles.  The Planning Board recommendation clearly states that the intent is a “guideline” for the granting authority.  Automobile dealerships are not listed under prohibited uses.  

David Gilvar, Manager of Sunna, LLC, said that Highway Commercial is located only at Exit 5. A Honda dealer is at the table because the nearest locations for Plymouth residents to take their vehicles for service are Weymouth, Hyannis, or Taunton.  The building will be LEED certified.  The taxes are $22,000 + now but after January the land will be classified as open space and the value will go down.  Between 50 and 60 jobs will be created.

Ron Mueller, Greenman-Pedersen, referred to a traffic manual used by engineers for trip generations and categories.  Automobile dealerships are considered retail uses and traffic at a car dealership is less than any other retail use.  

John Wisbach, a marketing agent for Honda spoke about the benefits to Plymouth residents.

Attorney Angley said that dealerships are truly a retail use.

#3546 – JORDAN HOSPITAL   
          275 Sandwich Street

Attorney Betters, representing the petitioner, said that the renovations are underway for the breast center.  The entry door had to be moved to accommodate the expansion.

Greg Ettridge, Engineer, reviewed the two entrances that have been taken out of service.  The new entry will service the cancer center.  

No public comment was offered.

#3549 – PLYMOUTH PUBLIC SCHOOLS   
          41 Obery Street

Sitting: Peter Conner, David Peck, Michael Main, Edward Conroy and Ryan Matthews.

Mr. Main read the legal advertisement into the record.
Scott Dunlap, AI3, said Plymouth was invited into the Massachusetts School Initiative program.  A model was selected in June and the process of bids and design got underway.  Construction should commence in June 2010 and take two years to complete.

Jim Jordan, AI3, said the building is a federal style building with many focal points.

No public comment was offered.

Mr. Main made a motion to overturn the decision of the Building Commissioner that a car dealership was not an allowed use.  

Mr. Conroy seconded.

Mr. Main made a motion to approve Case No. 3546.

Mr. Peck seconded.

Unanimously approved.

Mr. Main made a motion to approve Case No. 3549.

Mr. Peck seconded.

Unanimously approved.
