Zoning Board of Appeals Minutes June 17, 2009

Mr. Conner called the meeting to order and explained the procedures for the evening


Public Hearing
#3532 – LEVIS REALTY TRUST  
          102 Court Street

Sitting:  Peter Conner, A. Wendy Longo, William Keohan, David Peck, and Edward Conroy.

Mr. Peck read the legal advertisement into the record.

Attorney Betters, representing the petitioner, said the petitioner would like to add a third bay to his building for inspection services.  The state requires you to have a bay dedicated to inspections only.  The bump out will enclose the dumpster.  The lot is bounded by Papa Gino’s parking lot.   The Design Review Board requested that the Mansard roof be continued along the north side of the building.  The petitioner has not problem with that condition.  The Historic District approved the project.  The Mansard roof can’t go over the property line.  The gas pumps will be removed in 2012.  The building will be renovated at that time.  The colors will be changed and the Gulf sign may have to be removed.

#3533 – CAPUCINO REALTY TRUST

Mr. Peck read the legal advertisement into the record.

Mr. Parker, Land Management Systems, said the petitioner would like to alter a pre-existing non-conforming use.  A farm stand that was established prior to 1972 operated on this site as a legal non-conforming use and structure.  In 2000, the farm stand was convert to the building that exists today.  There are 10 parking spaces and only six are required.

Public comment offered in favor.

Mr. Presti, said that ninety percent of the store will be high end gifts.  He does not believe that his business will be competition to the Chapel.

#3534 – JOHN McALLISTER  
         101 White Horse Road

Sitting: Peter Conner, A. Wendy Longo, William Keohan, David Peck, and Edward Conroy.

Mr. Peck read the legal advertisement into the record.

Mr. McAllister said that his property was next to St. Catherine’s Chapel.  His request is for a 162 square foot addition off the kitchen so you don’t have to directly enter the house into the kitchen.  The deck is not being extended

Mr. Conroy made a motion to approve Case No. 3532 with condition as that the Mansard roof does not encroach over the property line.

Mr. Keohan seconded.

Unanimously granted.

#3533 – CAPUCINO REALTY TRUST
          629 State Road

Mr. Peck made a motion to approve Case No. 3533.

Mrs. Longo seconded.

Unanimously granted.

#3534 – JOHN McALLISTER
         101 White Horse Road

Mrs. Longo made a motion to approve Case No. 3534 with the condition that the flat roof be redesigned.

Mr. Conroy seconded.

Unanimously granted.
