Zoning Board of Appeals Minutes May 6, 2009

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing
#3523 – JEAN LOEWENBERG and LAWRENCE ROSENBLUM
        39/41 West Long Pond Road

Sitting:  Peter Conner, David Peck, Michael Main, William Keohan, and Edward Conroy.

Mr. Peck read the legal advertisement into the record.

Mr. Conner said that the petitioner’s attorney requested that the hearing be postponed to until later in the evening.

Attorney Angley, representing the petitioner appeared sooner than expected and proceeded with the written presentation on file in the ZBA office.

Mr. Flaherty, Flaherty & Stefani, reviewed the site and lot line adjustments. Minimal pine trees will be cut down.  The garage is 165’ back from West Long Pond Road.

Attorney Angley continued with the written presentation.

No public comment was offered.

Public Hearing
#3526 – Kathryn E. Ridder
        Boulevard/Saquish Beach

Sitting: Peter Conner, David Peck, William Keohan, Michael Main, and Edward Conroy.

Mr. Peck read the legal advertisement into the record.

Attorney Betters, representing the petitioner, said the original dwelling was destroyed by a storm in 2005.  Permits were obtained and allowed to lapse.   The structure conforms to setbacks.  The lot was created prior to zoning.


Mr. Bracken, reviewed the site and the area.  There are two ways to get to the property, a back road and the beach.  The Board of Health and the Conservation approved the house back in 2005 which has now expired.  No existing grades will be changed.  The site is not in velocity zone.  The structure will be on wood piles.

No public comment was offered in favor.

Mr. Peck seconded.

Unanimously granted.

Informal Matter
Case No. 3402 – Merritt E. Belle Isle
        891R Long Pond Road

Sitting: Peter Conner, David Peck, Michael Main, and William Keohan.

Mr. Parker, Land Management Systems, representing the petitioner, said that Condition No. 6 of the special permit required that the petitioner return with plans depicting a turn around half way down the driveway.

Mr. Main made a motion to accept Condition No. 6 as complete.

Mr. Peck seconded.

Unanimously approved. 4-0

No further business came before the Board.
