Members present:  Peter Conner, A. Wendy Longo, David Peck, William Keohan, and Michael Main.

Member absent: Marc Betti and Edward Conroy

Staff present: Peggy Fitzgibbons, Paul McAuliffe, and Jason Silva

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing
#3518 – HENLEY ENTERPRISES, INC. – Continued from March 18, 2009
                148 Samoset Street

Sitting:  Peter Conner, A. Wendy Longo, David Peck, Michael Main, and William Keohan.

Mr. Main read a memo he submitted to the Board members into the record.

Attorney Serkey, representing the petitioner, said the best way to proceed with this continuance is to have Mr. Bartolo review the changes to the plan.


Mr. Bartolo, Pesce Engineering & Associates, Inc., reviewed the site plan and commented on the revisions made as a result of comments from the Board and other committees.  The landscaping, driveways, traffic circulation, and pavement markings were all shown on the plan. The hydrant will be installed on the same side of the street however the main has not been located discussion with the Fire Department is still going on. The water department was contacted today to assist with the location of the water main.  The parking space at the entrance has been relocated to the rear of the lot. There are seven spaces along the back of the property line instead of the six shown on the original plans.  The fence around the dumpster will be vinyl.  The customers will enter the building from the back and exit in the front.

Mr. Smith, CEO, Henley Enterprises, said that a dry chemical suppression system must be installed by law.

Chief Bradley, Plymouth Fire Department, said the Fire Department would like to have more fire suppression in the building.  A request was sent to the State Fire Marshall but the response could take months.

Informal Matter
#3463 – JOHN J. DUGGAN

Sitting: Peter Conner, Wendy Longo, David Peck, William Keohan, and Michael Main.

Attorney Betters, representing the new owner of the property, said that with the economy the way it is the owner can’t proceed with the construction of the dwelling.  The question for the Board is verification that the Special Permit only required the road improvement and not the construction of the dwelling within the two year period.  The work will be done on the roadway before the two years expires.  The petition was for access only.

Mr. Peck asked if the roadwork would be done before the permit expires.

Attorney Betters replied that it would be.

Mr. Main made a motion to send a letter of confirmation to Attorney Betters that the dwelling did not have to be constructed within the two years.  

Mr. Peck seconded.

Unanimously granted.
VOTE:

A discussion ensued regarding the conditions of the permit.  All concerns of the Fire Department shall be addressed to the satisfaction of the Chief.

Mr. Main made a motion to approve Case No. 3518 with conditions.
Mr. Peck seconded.

Unanimously granted.

No further business came before the Board.
