Zoning Board of Appeals Minutes April 1, 2009

Mrs. Longo called the meeting to order and explained the procedures for the evening.

Public Hearing
#3520 – CHRISTOPHER POST
                20/22 Pleasant Street

Sitting: A. Wendy Longo, David Peck, Michael Main, Edward Conroy, and Marc Betti.

David Peck read the legal advertisement into the record.

Mr. Flaherty, Flaherty & Stefani, representing the petitioner, said the petitioner owns the property at 20/20 Pleasant Street (one structure) and the property at 14 Pleasant Street.  There is an existing driveway at 14 Pleasant Street that will be used to enter the parking spaces behind 20/22 Pleasant.  The six parking spaces being created will be 9’x18’ instead of the 10”x20’ required per the bylaw.   The clapboard on the building will be replaced.  A rain garden will be installed for the runoff.  Very little grading will take place.  Vegetation will be removed but no large trees.   The driveway at 14 Pleasant will be widened.  The cross easement will be recorded.
Mr. Main asked if the spaces could be made larger.
Mr. Flaherty replied that they could not without cutting a very large tree.
Mr. Peck asked how the water would flow to the rain garden with the contours going in the other direction.
Mr. Flaherty replied that the grade will be adjusted so it will hit the Cape Cod berm and flow to the rain garden.

Mr. Post said that he had spoken to Ms. Walton previously and was willing to try to work something out with her regarding the screening.

VOTE:

Mr. Main made a motion to approve subject to the following conditions:
The petitioner shall provide a recorded copy of a cross-access easement from the Registry of Deeds prior to a certificate of occupancy being issued.
The petitioner shall submit a more detailed drainage and planting plan to the Zoning Board of Appeals for review and approval at an informal meeting.  The said plan shall depict the screening of the abutter’s property line.
The petitioner shall submit stamped floor plans for completion of the file.
Mr. Peck seconded.
The vote was unanimous. (5-0)

Public Hearing
#3521 – RANDY C. and ANITA GALLETTI
                122 Drew Road

Mrs. Longo said that the petitioner has requested a continuance to the next available date.
Mr. Peck read the legal advertisement and a letter from Mr. Flaherty, Flaherty & Stefani requesting a continuance into the record.
Mrs. Longo said that the next available date was April 29, 2009 at 7:30 p.m. and asked for a motion.
Mr. Main made a motion to continue Case No. 3521 to April 29, 2009 at 7:30 p.m.
Mr. Peck seconded.

No further business came before the Board.

W. Longo made a motion to adjourn.
The vote was unanimous.
