MEMBERS PRESENT:  Peter Conner, A. Wendy Longo, William Keohan, David Peck,

Mr. Conner called the meeting to order and explained the procedures for the evening.   

CASE NO. 3499 (Revised) – ROBERT McMAKIN – COCHITUATE ROAD

Sitting: Peter Conner, William Keohan, Michael Main, David Peck, and A. Wendy Longo.

Mr. Peck read legal advertisement into the record.

Mr. Conner acknowledged receipt of letters in support of the project received at the meeting.

Mr. Flaherty, Flaherty & Stefani, representing the petitioner, said that the petitioner would like to demolish an existing dwelling and rebuild a three story dwelling.  The first application has some confusion with the plan because it was labeled a two-story dwelling with an attic.  The dwelling was constructed in 1955.   A one-car garage is proposed under.  The bedroom count will remain at four. The site is serviced by Town water.  The site has retaining walls in the front, side and rear of the property.  The existing footprint will be enlarged by 5’.

The design of the dwelling is inspired by the Architecture of the American Summer which was defined in the 1890’s.  The detail characteristics of the exterior are sweeping roofline, soffits detailed with crown moldings, and continuous wood shingle siding.

The proposed dwelling has been designed keeping in mind that the McMakin’s didn’t want Mrs. Canavan to loose the view of the water.  

The footprint will increase from 2000 square feet to 2775 square feet.  The proposed height is 34’.  The soil has been tested. The two foot overhang will decrease the side setbacks on both sides of the property.
Public comment offered on the project were questions regarding the proposed.

A very long discussion ensued regarding the enlarged footprint.  Documentation submitted did not state that the footprint was enlarged other than the roof overhang.

Mr. McAuliffe said that the Building Department could not issue a building permit for a structure larger than 31’ x 30’ as advertised.
The Board voted that the legal advertisement be redone with the correct measurements of the proposed dwelling.

Mr. Main made a motion to continue Case No. 3499 to Wednesday, October 1, 2008 at 7:45 p.m. with publication of legal notice with correct dimensions of the dwelling.

Mrs. Longo seconded.

Unanimously continued to October 1, 2008 at 7:45 p.m.

CASE NO. 3500 – 12 RESNIK ROAD LLC – RESNIK ROAD

Sitting: Peter Conner, A. Wendy Longo, David Peck, William Keohan, and Michael Main.

Mr. Peck read the legal advertisement into the record.

Attorney Winokur, Winokur, Serkey, and Rosenberg, representing the petitioner, referred to a written presentation on file in the ZBA office.

The parcel consists of 85,253 square feet with an industrial/business building thereon.  Currently there are 58 parking spaces on the site.  The building was permitted in 2006.

Mr. Shaw, Associated Engineers, said that the parking was approved by the Zoning Department in 2006 for the addition of 30 spaces but was not implemented.   The site has minimal retaining walls.

Mr. Henson, Landscape Architect, said that there is substantial vegetation existing on the site.  The vegetation will be expanded to buffer the paved area.  The dumpster will be located on the concrete pad and will be fenced and screened.   The storage area will be in the front area depicted on the plans.

Mr. McAuliffe said that he was not aware of the storage request and that the storage area would not be allowed in the front.  

Mr. Shaw replied that the parking spaced would be moved to the front and the storage would go to the rear of the site.

A very long discussion ensued regarding the school and the children playing next to the site.  The petitioner agreed to provide some form of protective screening so the children would not chase balls into the area of the parking on this site.

No public comment was offered.

Mrs. Longo made a motion to approve Case No. 3500 with conditions.

Mr. Main seconded.

Unanimously approved.

INFORMAL MATTER

CASE NO. 3426 – BARRY TASSINARI – SAMOSET STREET

Sitting: Peter Conner, David Peck, William Keohan, Michael Main, and Marc Betti.

The Board viewed photos of the fence and landscaping.

Mr. Main made a motion to approve the landscaping and fence.

Mr. Peck seconded.

Unanimously approved.

No further business came before the Board.
