Mr. Conner called the meeting to order and explained the procedures for the evening.
CASE NO. 3498 – ROBERT CLARKE – REAR BRIAN’S WAY

Mr. Conner acknowledged receipt of two letters received today. One letter was in support the other in opposition.
Mr. Flaherty, Flaherty & Stefani, Inc., representing the petitioner said that the dwelling was purchased two years ago and is in a state of disrepair. The petitioner would like to demolish and rebuild a new two story dwelling. The paper street would have no reason to be improved.
Mr. Noseworthy, Fornaciari & Noseworthy, said that the new dwelling would have two bedrooms and one bath and be approximately 23’ in height. The existing footprint will be the same except for the stoop.
Mr. Flaherty, said that if the dwelling was not demolished it would have to be lifted to put a foundation under the existing structure. The house is 57 years old. The petitioner does not have a problem with a deed restriction for only two bedrooms. The grades will be maintained adding a second story would not overcrowd the neighborhood as the house is a three bedroom now and would be going down to a two bedroom. The access to the site will not change.

Mr. Flaherty said that the dwelling was beyond renovations. The dormer windows would be removed the dwelling facing Ms. Kerrigan.

CASE NO. 3490 – LATE NIGHT LLC – LONG POND ROAD

Mr. Main read the legal advertisement into the record.
Attorney Betters, representing the petitioner, said that the Board originally heard this case in 2004 when an Olive Garden restaurant was planned for the site. The curb cuts are already in place. Phase II is the project that the Board is reviewing tonight. The petitioner is asking for changes to the original conditions concerning Condition No. 2, 5, & 6. Tenants have not been identified. The petitioner will contribute $20,000.00 toward the traffic signal. The petitioner is proposing to eliminate the curb cut on Holman Road. The earthen berms were not put in on the first phase of the project. There are 163 parking spaces required and 163 shown on the plan. The request to waive the parking requirements is because the tenants are unknown. The Planning
Staff recommended approval and the Planning Board did not agree with staff and recommended denial.
Mr. Shaw, Associated Engineers of Plymouth, said the existing grades on the site have a 14’ differential. There are currently 120 spaces on site and 43 spaces will be added. All utilities are on site.
Mr. Dirk, Vanasse & Associates, said new traffic volume history was obtained ranging from the intersection at Camelot Drive to the northbound ramps at Route 3. A connector road to Home Depot Drive was not viable. The recommendation is for one signalized system for the entire area. The fair share contribution from the petitioner was agreed upon at $20,000.
A very long discussion ensued regarding the signal.
Mr. Shaw said the curb cut on Holman Road is a hang over from 1983 when the Town was looking at curb cut reductions.
Jon Henson, Landscape Architect, said that the berms would have been very low because of site lines. Planting will be substantial.
Another very long discussion ensued regarding the original presentation and the berms in front of the Phase I building.
No public comment was offered.
Attorney Betters said that if the Board wants the mounding to be installed it will be.
The requests that the petitioner is making tonight is to eliminate Condition #2, bullet 3 and Condition #5.
Mr. Dirk said that the truck turning movements will be done if adjustments are needed they will be done.

Mrs. Longo made a motion to grant Case No. 3498 with the condition that the dormer windows be removed.
Mr. Conroy seconded.

Mr. Main made a motion to grant Case No. 3490.
Mr. Betti seconded.
4-1 Granted with Mr. Keohan opposed.
