Mr. Conner called the meeting to order and explained the procedures for the evening.
CASE NO. 3495 – SEAN C. MAHONEY – PEARL STREET

Mr. Peck read legal advertisement into the record.
Attorney Galvin, representing the petitioner, said that his client would like to construct a new wooden deck. The deck will encroach into the side setback.
Mr. Mahoney said that he had raised the dwelling to put in a foundation and a knee wall.

CASE NO. 3496 – NASR REALTY TRUST – COMMERCE WAY

Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office. There was confusion with the filing of the zoning permit which lead to the building being advertised at the larger size.
Steve Kotowski, Webby Engineering reviewed the site plan. The northbound traffic will be right turn in and out only. Two additional retail uses are planned however the petitioner does not know what they will be at this time. Rumble strips prevent vehicles from crossing into the site from the southbound side of Commerce Way. The dumpster will be located in the southeast corner of the property. The plan that Mr. Kotowski was reviewing was not the plan that was filed with the Zoning Board of Appeals petition. The plan was revised on 7/14/08.
Jon Henson, Landscape Architect, said that the site is void of any vegetation. Berms are proposed for the front of Commerce Way. The site has the electric easement on it. Evergreens will be used throughout the site. Foundation planting will be used to soften the site.
Walter Fuller, Cubic Architects, reviewed the layout of the front of the building. The building will have steel walls and the parapets are to screen the roof top mechanicals.
The petitioner preferred to go with the design on sheet A9.02.
Mr. Peck requested that elevations for the sides and rear of the building be provided to the Board for review.
Attorney Angley continued with his written presentation.

CASE NO. 3497 – JEWEL TRUST – WEST LONG POND ROAD

Mr. Peck read the legal advertisement into the record.
Attorney Abbott, representing the petitioner, said that Mr. Wallace purchased the property two years ago from the Corsini’s. The Corsini family purchased the property in 1943 and lived there until the Wallace’s purchased it. Substantial renovations needed to be done so more than 50% of the dwelling needed to be destroyed. The roof will have 1700-sq. ft. of “green roof”.
Mr. Flaherty, Flaherty & Stefani, Inc., representing the petitioner, said that the dwelling is below street level. The site is deeply wooded. The septic system was upgraded.
Mr. Coots, reviewed the design of the dwelling.
Mr. Wallace said that the buffer has been started and 7 trees have already been planted.

Mr. Main made a motion to grant Case No. 3496 with conditions in Planning Board recommendation with additional conditions for the side and back elevations, landscaping, signals, and $5000.00 in traffic mitigation for Commerce Way area.
Mr. Peck seconded.
Unanimously granted.

Mr. Peck made a motion to approve Case No. 3497 with conditions.
