Zoning Board of Appeals Minutes July 2, 2008
MEMBERS PRESENT:  Peter Conner, David Peck, William Keohan, Wendy Longo,
Michael Main, and Marc Betti.

MEMBER ABSENT: Edward Conroy

STAFF: Peggy Fitzgibbons and Paul McAuliffe

Mr. Conner asked the audience for their indulgence while the Board re-organized.

Mrs. Longo opened the nominations for Chair.
Mr. Main nominated Mr. Conner for Chair.
Mr. Peck seconded.
Unanimous

Mr. Conner resumed as Chair and opened the nominations for Vice-Chair.
Mr. Main nominated Mrs. Longo for Vice-Chair.
Mr. Peck seconded.
Unanimous

Mr. Conner opened nominations for Clerk.
Mr. Main nominated Mr. Peck as Clerk.
Mrs. Longo seconded.
Unanimous

Mr. Conner called the meeting to order and explained the procedures for the evening.   

CASE NO. 3492 – DAVID and MARY-ANN BRIDGWOOD – CAPE COD AVENUE

Sitting: Peter Conner, Wendy Longo, David Peck, William Keohan, and Michael Main.

Mr. Peck read legal advertisement into the record.

Mr. Bridgwood said that there is an existing small deck that is not functional.  Fill will need to be used to level off the yard.

No public comment was offered in favor.

CASE NO. 3293 - ANNAMARIA K. MURRAY – LAKE AVENUE

Sitting: Peter Conner, Wendy Longo, David Peck, William Keohan, and Michael Main.

Mr. Peck read the legal advertisement into the record.

Attorney Machado said that the property was purchased by the Murray’s in 2006 and was held in contiguous ownership.  Mrs. Murray believed that she could sell the land if she needed money.

Attorney Machado said that the hardship was that Mrs. Murray paid $60,000 for a piece of land she believed she could sell.

CASE NO. 3494 – SHAWN and MERTYNE LUNNEY – ASIAF WAY

Sitting: Peter Conner, Wendy Longo, David Peck, William Keohan, and Michael Main.

Mr. Peck read the legal advertisement into the record.

Mr. Flaherty, Flaherty & Stefani, Inc., representing the petitioner referred to a written presentation on file in the ZBA office.  The reference to a retaining wall in the report from the Design Review Board is incorrect there is no retaining wall needed.

No public comment was offered.

After much deliberation Mr. Main made a motion to deny Case No. 3492 without prejudice.

Mr. Peck seconded.

Unanimously denied without prejudice.

CASE NO. 3293 - ANNAMARIA K. MURRAY – LAKE AVENUE

Mr. Peck made a motion to deny Case No. 3493.

Mr. Main seconded.

Unanimously denied.

CASE NO. 3494 – SHAWN and MERTYNE LUNNEY – ASIAF WAY

Mr. Main made a motion to approve Case No. 3494 with one condition.

Mr. Peck seconded.

Unanimously granted.
