Mr. Conner called the meeting to order and explained the procedures for the evening.
CASE NO. 3439R – SECURED REALTY, INC. – STATE ROAD – Remand from Land Court – Continued from April 2, 2008, April 9, 2008, and May 7, 2008.

Mr. Peck read legal advertisement into the record.
Attorney Angley, representing the petitioner, referred to a written presentation on file in the Zoning Board of Appeals office.
Mr. Shaw, Associated Engineers, said all infrastructure is pre 1995. All drainage is contained on site. No open pits.
Mr. Henson, Landscaping Architect, reviewed the buffering and landscaping on the property. The vegetation will be reinforced along Wedgewood Drive. Each townhouse will have a garage. Foundation plantings will be placed in front of each unit. The entrance will have a neighborhood drive feel. Old County Road has higher elevations and the existing vegetation acts as a buffer. There will be 16 townhouse units and one low rise building with 14 units with a garage level.
Mr. Pompkin, Maugel Architects, Inc. said that the focal point of the building is the entrance. The one bedroom units will have 900 sq. ft. and the 2 bedroom units will have 1300 sq. ft.
Mr. Muller reviewed the traffic study that was done when Cedarville Commons was proceeding forward. The study was reviewed by CDM.
Attorney Angley said that the Town Engineer was pleased with the design of the traffic signal. The cross easement does exist and will be submitted for review.

Attorney Angley continued with his written presentation and a discussion ensued on the conditions for the permit.

Mr. Peck made a motion to approve all four special permits and the request for waivers and adopt the Planning Board conditions with the exceptions as discussed.
Mrs. Longo seconded.
Unanimously granted.
Mr. Conner said that the Board would be entering into Executive Session to discuss pending litigation.

CASE NO. 3284 SAWMILL WOODS - off KATHLEEN DRIVE
Mr. Keohan made a motion to delete condition B10 and add the sentence that the modification does not take affect until and unless the applicant withdraws its HAC appeal and is dismissed.
Unanimously granted.
