Zoning Board of Appeals Minutes March 19, 2008
MEMBERS PRESENT: Peter Conner, David Peck, William Keohan, Marc Betti, and Michael Main.  

MEMBERS ABSENT: William Sims and Wendy Longo


STAFF PRESENT: Peggy Fitzgibbons, Paul Vecchi, and Jason Silva

Mr. Conner called the meeting to order and explained the procedures for the evening.  

CASE NO. 3478 – TEDESCHI FOOD SHOP – STATE ROAD

Sitting: Peter Conner, William Keohan, David Peck, Marc Betti, and Michael Main.

Mr. Peck read the legal advertisement into the record.

Attorney Kraus, representing the petitioner, asked that the Board continue this case until the summer in order to give his client time to address the concerns of Valerie Massard and the Planning Board.  

Mr. Conner asked Attorney Kraus if he plans were going to be revised and if he was aware that all revisions needed to be filed with Peggy in the ZBA office prior to giving them to the Planning Board.  

Attorney Kraus replied that the plans would be revised slightly and that everything would go though Peggy.

Mr. Main made a motion to continue Case No. 3478 to June 4, 2008 at 7:30 p.m.

Mr. Peck seconded.

Unanimously continued.

CASE NO. 3479 – ERIC J. PONTIFF, INC. – BLACK CAT ROAD

Sitting: Peter Conner, William Keohan, David Peck, Marc Betti, and Michael Main.

Mr. Peck read the legal advertisement in the record.

Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.

Mr. Flaherty, Flaherty & Stefani, said that the Planning Board sign a plan for 4 single family house lots back in 2007.  The petitioner has not recorded that plan.  He would like to construct one dwelling and put a restriction on the property that the 27 acres remain cranberry bogs.   The tailwater recovery pond on Black Cat Road is town owned.  The project should be complete within two years.    

Attorney Angley continued with his written presentation.

INFORMAL MATTER


CASE NO 3463 – JOHN J. DUGGAN – MASSASOIT AVENUE

Sitting: Peter Conner, David Peck, Michael Main, and Marc Betti.

Mr. Flaherty, Flaherty & Stefani, reviewed the conditions of approval.   The neighbor that was concerned about the buffer has requested that there be no goldenrod and Mr. Duggan agreed.

Mr. Main made a motion to accept Condition No. 1 and No. 2 as complete.

Mr. Betti seconded.

Unanimously approved.  


CASE NO. 3479 – ERIC J. PONTIFF, INC. – BLACK CAT ROAD

Mr. Main made a motion to approve Case No. 3479 with conditions.

Mr. Betti seconded.

Unanimously granted.

No further business came before the Board.
