Zoning Board of Appeals Minutes January 30, 2008
MEMBERS PRESENT: Peter Conner, A. Wendy Longo, David Peck, William Keohan, William Sims, Michael Main, and Marc Betti.  

STAFF PRESENT: Peggy Fitzgibbons and Jason Silva

Mr. Conner called the meeting to order and explained the procedures for the evening.  

Prior to starting the hearings the Board voted for a new Clerk.

Mrs. Longo nominated David Peck.

Mr. Sims seconded.

No other nominations.

Mr. Peck was unanimously appointed as Clerk.   


CASE NO. 3457 – BRUCE ORCUTT – CENTRAL AVENUE – Continued from November 14, 2007.

Sitting: Peter Conner, Wendy Longo, William Keohan, David Peck, and William Sims.

The legal advertisement was read into the record at the November 14, 2007 hearing.

Attorney Barthel, Gillis & Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.   

Mr. Flaherty, Flaherty & Stefani, Inc., reviewed an aerial photo and site plan on file in the ZBA office.

Attorney Barthel, continued with the written presentation.
No public comment was offered.

CASE NO. 3469 – ANNE & EUGENE DiFRANCESCO – LONG POND ROAD

Sitting: Peter Conner, Wendy Longo, William Keohan, David Peck, and William Sims.

Mr. Peck read the legal advertisement into the record.

Mrs. DiFrancesco said that she was requesting to extend the deck and put in an above ground pool.  The pool is not part of the petition because it meets the setback however Mr. Manfredi included it in the petition to prevent confusion in later years.  Approximately 20 years ago the deck was built by the previous homeowner without permits.

Public comment offered in favor.

CASE NO. 3470 – NICK PAPAS – BUZZARDS BAY DRIVE

Sitting: Peter Conner, Wendy Longo, William Keohan, David Peck, and William Sims.

Mr. Peck read the legal advertisement into the record.

Mr. Shanon, representing the petitioner, said the deck will be demolished and a carport will be constructed.  New French doors have been put in and there will be three steps going from the carport into the house.

No public comment was offered.

INFORMAL MATTER

CASE NO. 3430 – NTB – PHASE 4 – COLONY PLACE

Sitting: Peter Conner, Wendy Longo, Bill Keohan, and David Peck.

Attorney Barthel, Gillis & Angley, representing the petitioner, said that the petitioner was required to return to the Board informally for approval of the landscaping plan at the NTB.

Chris Jones, Carol R. Johnson Associates, landscape architect, said that the plan presented to the Board this evening was an enhancement of the original plan submitted.  Approximately 720 plantings added to the site.

A discussion ensued between Board members regarding the connection of the internal sidewalk to the crosswalk on Colony Place.

Mr. Jones replied that he was not aware that the Board wanted a sidewalk but one could be put in.

Mrs. Longo made a motion to accept the landscaping plans as presented with the addition of a 5’ sidewalk connecting to the crosswalk on Colony Place.  The plans shall be submitted to the ZBA office for completion of the file.

Unanimously approved. 4-0


VOTES:

CASE NO. 3457 – BRUCE ORCUTT – CENTRAL AVENUE

Mr. Sims made a motion to approve Case No. 3457 with one condition.

Mr. Peck seconded.

Unanimously granted.


CASE NO. 3469 – ANNE & EUGENE DiFRANCESCO – LONG POND ROAD

Mr. Peck made a motion to approve Case No. 3469 with conditions.

Mrs. Longo seconded.

Unanimously granted.


CASE NO. 3470 – NICK PAPAS – BUZZARDS BAY DRIVE

Mrs. Longo made a motion to grant Case No. 3470 with conditions.

Mr. Sims seconded.

Unanimously granted.

No further business came before the Board.
