CASE NO. 3462 – GOLDEN LIVING CENTER – OBERY STREET

Mr. Peck read the legal advertisement into the record.
Mr. Cunningham, Sunshine Sign Company, representing the petitioner, said that his client would like to erect the original sign design that was submitted with the application. The Planning Board asked me to redesign the sign and bring it with me to present to the Board as an alternative.

CASE NO. 3463 – JOHN J. and PATRICIA DUGGAN – MASSASOIT AVENUE

Mr. Peck read the legal advertisement into the record.
Attorney Betters, representing the petitioner, said that his client need access relief. The lot is a buildable lot according to the By-law. The letter the Board received from Mr. Groves is not germane to the case before the Board this evening. Mr. Duggan does have intentions of repairing the sea wall.
Mr. Flaherty, P. E., Flaherty & Stefani, Inc., reviewed the access and the drainage improvements that would be made if petition was approved.

Mr. Main made a motion to grant Case No. 3462.
Mrs. Longo seconded.
A very long discussion ensued regarding the original sign and the newly submitted sign.
Granted unanimously.
CASE NO. 3463 – JOHN J. and PATRICIA M. DUGGAN – MASSASOIT AVENUE
Mr. Betti made a motion to approve Case No. 3463 with conditions.
Mr. Main seconded.
Granted unanimously.
INFORMAL MATTER
CASE NO. 3304 – VILLAGE GATE CONDOMINIUMS – STATE ROAD (James LaCava)
Mr. Manfredi requested that the Board make a determination regarding the occupancy permits for two units that are built and ready to be conveyed. A letter addressed to Mr. Manfredi from Attorney Angley was submitted to the Board for review.
The Board determined that the occupancy permit should not be withheld pending the signing of the Memorandum of Understanding as the condition does not require that the affordable unit be constructed prior to the sale of any other units. The condition requires that the petitioner designate a unit as “affordable”.
Mr. Main made a motion to authorize Mr. Manfredi to issue the occupancy permits on the two units that are ready to be conveyed.
Mr. Peck seconded.
Unanimously granted.
