CASE NO. 3440 – BOBCAT PARTNERS, LLC – COURT STREET

Attorney Betters, representing the Office of Community Development, said the property is owned by the Town of Plymouth and has sat vacant for several years. No expansion of the footprint of the building is proposed. Two dormers will be added to the front of the building. Eight units are allowed by right, thirteen units are being proposed. The building is setback 47’ from the road. Parking is grandfathered. The tenants will be required to purchase resident parking stickers as part of their lease.
Mr. Arons, Director of Community Development, said that the parking sticker can’t be incorporated into the rent as the leases will be HUD controlled.
Attorney Betters said the landlord will collect the money for the parking stickers from the tenants.

Jay McMichael, Architect from Coastal Engineering, reviewed the walkways, parking behind Memorial Hall, portico, and lighting.
Mr. Arons reviewed the affordability component and the income levels for the one year leases.
Attorney Betters, reviewed the conditions as stated in the Planning Board recommendation.

INFORMAL MATTER
CASE NO. 3232 – MANOMET PONDS – BROOK ROAD
Sitting: William Keohan, David Peck, Michael Main, and Peter Conner.
Attorney Pawle, Kopelman & Paige, said that after several discussions with Attorney Kraus and Phyllis Zinicola at MassHousing the Regulatory Agreement has been modified to reflect the acceptable language for all parties. The petitioner has also requested a two extension to the permit which does not expire until September of 2008 and a modification to the lottery/affordability monitoring agent. The permit is valid for three years leaving one remaining year on the permit. The Board must act reasonably when a considering an extension of the permit.
Mr. Main made a motion to accept the Acknowledgement changing the first paragraph of condition B9, found on page 9 of the Comprehensive Permit to “prior to the issuance of any building permits for the Development Project and prior to the Applicant’s conveyance of any of the dwellings in the Development Project, the Applicant shall execute and record a Regulatory Agreement with MassHousing.
Mr. Peck seconded.
Unanimously granted.
Mr. Main made a motion to approve Section III, Conditions attached to the Comprehensive Permit, A. General Conditions, paragraph 11, deleting the words “three years” in the first and second sentences and replacing them with the words “four years”.
Mr. Peck seconded.
Unanimously granted.
Mr. Main made a motion to approve in Section III, Conditions attached to the Comprehensive Permit, B. Affordability Requirements, paragraphs 6 and 9, deleting said paragraphs 6 and 9 and replacing them with the revised paragraphs 6 and 9 attached as Exhibit A.
Mr. Peck seconded.
