Mr. Conner called the meeting to order and explained procedures for the evening.
CASE NO. 3424– KEVIN GRIFFIN – POND ROAD

Mr. Richard read the legal advertisement into the record.
Mr. Griffin said that he would like to construct a two car garage and that he had no issues with the conditions in the Planning Board recommendation.
Mr. Conner asked the petitioner if he was going to remove the two sheds.
Mr. Griffin replied that he was.

Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.
Mr. Shaw, Associated Engineers, reviewed the site. The site is accessed through Resnik Road but the frontage is on Commerce Way. 25,000 cubic yards have to be removed in order to prepare the land for the building.
Mr. Metcalfe, Architect, reviewed the building. It is a single story, pre-manufactured steel building.
Mr. Henson, Landscape Architect, reviewed the landscaping.
Mr. Shaw said that to prevent the trucks from going through the park, the petitioner could request a temporary curb cut on Commerce Way then right out to Route 80.

INFORMAL MATTER
CASE NO. 3355 – FOUR OC LLC – COMMERCE WAY
SOVEREIGN BANK
Sitting: Peter Conner, Wendy Longo, Robert Richard, and David Peck.
Attorney Betters, representing the petitioner, said that he was back before the Board for Sovereign Bank. The Board had concerns with the conflicts in the drive-thru lane of vehicles crossing in front of each other. The bank drive thru has been moved away from the building and the Dunkin Donuts will be closest to the building.
Peter Glick, Symmes, Maini & McKee Assoicates, said the site will have “DO NOT ENTER” signs. The last two spaces closest to the stop sign will be marked “Employee Only Parking”.
Jack Meehl, Regional President, Sovereign Bank, said that the by-pass lane is needed because people do need to get out of line for emergencies or time delays.
Mr. Richard made a motion to accept Condition No. 3 for the Sovereign Bank as completed.
Mr. Peck seconded.

WENDY’S
Attorney Betters, said that the Wendy’s would be a single story 3700-sq.ft. building. Mechanicals will be screened from view. There will be one drive through window.
Mrs. Longo made a motion to accept Condition No. 3 for Wendy’s as complete.

CASE NO. 3089 – BOAT YARD SQUARE CONDO TRUST – CASWELL LANE

Attorney Betters referred to a written letter on file in the ZBA office. The five parking spaces in question are along Caswell Lane. The Chamber is no longer a tenant and the parking lot does not get full. If at any time the determination is made that the spaces are needed the petitioner will provide them.
Mrs. Longo made a motion that the 5 spaces are not mandatory at this time.
Mr. Conner seconded.

CASE NO. 3293 – GEORGE A. BENWAY, III – WAREHAM ROAD
Sitting: Mr. Conner, Mrs. Longo, and Mr. Richard
Mrs. Longo made a motion that the modification to the Comprehensive Permit was insubstantial.
Mr. Richard seconded.
Mr. Conner signed the Regulatory Agreement as agreed to by the Board.
