Zoning Board of Appeals Minutes April 11, 2007

MEMBERS PRESENT: Peter Conner, William Keohan, Michael Main, David Peck, and Marc Betti, A. Wendy Longo and Robert Richard.

Mr. Conner called the meeting to order and explained procedures for the evening.

CASE NO. 3411– CHURCHILL OIL REALTY TRUST – STATE ROAD

Sitting: Peter Conner, A. Wendy Longo, William Keohan, David Peck, and Robert Richard.

Mr. Richard read the legal advertisement into the record.

Attorney Betters, representing the petitioner, said the petitioner would like to demolish the existing building and reconstruct a 1 ½ story building.  Customer Service will be relocated from the back of the site to the front. There will be more than one structure on the property.  

Mr. Richard asked the petitioner if there would be a gas station.

Mr. Churchill replied that there would be no gasoline.

Mr. Peck asked the petitioner why the Design Review Board requested straight in parking instead of the angle parking.

Mr. Parker, Land Management Systems, the Board believed that it would be easier for trucks to negotiate and cars wouldn’t be backing out.

Mr. Conner asked the petitioner if the reduction in width from 30’ to 27’ was workable.

Mr. Parker replied that it was.

No public comment offered.
Attorney Betters said that the petitioner had no objection to the Design Review Board.

CASE NO. 3412 – KENNETH B. and PATSY A. FRASIER – KINGSTON ROAD

Sitting: Peter Conner, A. Wendy Longo, William Keohan, David Peck, and Robert Richard.

Mr. Richard read the legal advertisement into the record.

Mr. Flaherty, Flaherty & Stefani, representing the petitioner, said site is located in the Colony Beach area of Manomet. .The subdivision was laid out in the 1950’s.  Most of the area consists of gravel roads.   The roadway meets the 16’ access way requirements.  Two cars can comfortably pass each other.  All roads are private.   The petitioner would like to construct a two-story dwelling with a one car garage.  

No public comment offered in favor.

Mr. Flaherty said that the drainage problem that has existed for years will be corrected with the drainage systems proposed.

Mrs Longo made a motion to grant Case No. 3411 with conditions.

Mr. Richard seconded.

Unanimously granted.


CASE NO. 3412 – KENNETH B. and PATSY A. FRASIER – KINGSTON ROAD

Mr. Richard made a motion to grant Case No. 3412 with conditions.

Mr. Peck seconded.

Granted 4-1 (Mr. Keohan opposed).

Attorney Angley, representing the petitioner, presented plans for approval in according to Conditions 1, 2, & 3.  

Mr. Main made a motion to approve.

Mr. Peck seconded.

Unanimously granted.

CASE NO. 3379 – KARSTEN COMPANY – WATER STREET

Sitting: Peter Conner, William Keohan, David Peck, Robert Richard, and Michael Main.

Attorney Angley, representing the petitioner said his client is seeking approval of conditions and an acknowledgement that the directive the Board gave the petitioner back in August was in compliance in order to move forward with the final engineering.

Mr. Peck made a motion to approve conditions and acknowledged that the changes are in compliance with the permit.

Mr. Richard seconded.

Unanimously approved.

No further business came before the Board.
