Mr. Conner called the meeting to order and explained procedures for the evening.
CASE NO. 3406– EASTPORT BAYSIDE LLC – CASWELL LANE

Mr. Peck read the legal advertisement into the record.
Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office. The petitioner applied for a permit in December, 2006 for 5 units. The petition was denied without prejudice. This petition is reduced to 4 units.
Mr. Fuller, Landscape Architect reviewed the site. The lot is presently overgrown. The structures will have two elevations. The basements have been removed and replaced with a utility crawl space. Two units are 2’ lower than the other two units. Fifty-eight percent of the property will be green space. The side yard setbacks have been met. Each unit will have driveways facing addressStreetCaswell Lane and each will have 3 parking spaces. No improvements to the rear along the Town property. The open swale will remain as it is.
No connection between park and this site. The landscaping is extensive. The petitioner will work with abutters so view is not blocked by vegetation. White cedar shingles with green trim and wooden decks, close to the ground, will be used on the exterior. All units are three bedrooms.
Attorney Angley continued with written presentation.
Mr. Price, Management Member, Eastport Bayside LLC said the company listened to the concerns of the Board and reduce the number of units. The project is a quality project. The petitioner does not wish to put a sidewalk on the north side of addressStreetCaswell Lane. The Planning Board made it a condition of their recommendation that the sidewalk be removed.
No public comment was offered in favor.
A letter of support was received from addressStreetBoatyard Square.

Attorney Angley said that a Notice of Intent would be filed with the Conservation Commission. A maintenance plan will be submitted to the Zoning Board.

CASE NO. 3407 – LINDSAY LEAST – COURT STREET

Mr. Peck read the legal advertisement into the record.
Mr. Flaherty, Flaherty & Stefani, representing the petitioner, said the dwelling was constructed in 1901. On street parking is allowed in the area. Cars can’t enter the garage the way it is because the opening is too small. The reconstructed garage and addition will be attached to the house.

Mr. Main made a motion to allow the petitioner to withdraw the petition.
