Zoning Board of Appeals Minutes November 8, 2006
MEMBERS PRESENT: Peter Conner, A. Wendy Longo, Robert Richard, Bill Keohan, David Peck, Michael Main, and Marc Betti.

COUNSEL PRESENT: Ilana Quirk

Mr. Conner called the meeting to order and explained the procedures for the evening..   

CASE NO. 3387 – BOG VIEW LLC  – BEAVER DAM ROAD

Sitting: Peter Conner, Wendy Longo, Robert Richard, David Peck, and Michael Main.

Mr. Richard read the legal advertisement into the record.

Attorney Angley, representing the petitioner, referred to a written presentation.  The Board received a letter from Flaherty & Stefani.  There are presently four curb cuts on Beaver Dam Road.  There is no rear setback because this is a corner lot.  

Jon Hensen, Landscape Architect, said that the existing structures will be retained.  The entry point will be off Minuteman Lane.  Exit will be out onto Beaver Dam Road.  The number of curb cuts will be reduced on Beaver Dam Road.  Pedestrian walkways will be located throughout the site.  Private areas will be located to the rear.  Small canopy trees will break up the units.  A bench walls will be placed around the existing duplexes to separate the driveway.  All runoff will be on site.  The site will be served by Town water.  There will be one hydrant on site and one on Beaver Dam Road.  A bus shelter will be located at the front of the site for students to wait for the bus.  There are no site line issues.   The internal roadways are 25’ wide.

Attorney Angley said that a Condominium Association would be created.  The parking spaces will be enlarged to 10’ x 18’.

Attorney Quirk asked the petitioner how many curb cuts to the property are located on Beaver Dam Road.

Mr. Hensen replied four.

Attorney Quirk said that the petitioner should have the following issues addressed before the next meeting:
        The driveway issue with the abutter.
        All affordable units must be 3-bedroom.
        The affordable units will be in separate buildings.
        Regulatory Agreement
        Deed Rider
        Monitoring Agreement
        Condominium Master Deed
        Condominium Declaration of Trust

Mr. Main made a motion to continue Case No. 3387 to December 20, 2006 at 7:30 p.m.

Mr. Peck seconded.

Unanimously continued.

CASE NO. 3355 – FOUR OC LLC – COMMERCE WAY

Attorney Betters, representing the petitioner, said that his client is asking to do the preliminary site work.  The retaining wall needs a building permit and the Building Department can’t issue any permits until we satisfy Conditions 1 & 2.  The building locations are on the site plan and they will not change.  The petitioner will return to the Board with the design of the buildings and the details on parking spaces at a future date and this information will be incorporated in subsequent phases when tenants are identified.

MR. Richard made a motion to approve Conditions No. 1 & 2 as complete.

Mr. Peck seconded.

Unanimously approved.

Mr. Conner moved to go into Executive Session to discuss litigation strategy and would not return to open session.
