Zoning Board of Appeals Minutes September 6, 2006

MEMBERS PRESENT: Peter Conner, David Peck, Robert Richard, Bill Keohan, Michael Main, and Marc Betti.

Mr. Conner called the meeting to order and explained the procedures for the evening.  

Case No. 3373 – Adriano Cimbron – Cedarhill Park Drive – Continued from July 5, 2006

Sitting: Peter Conner, David Peck, Robert Richard, Bill Keohan, and Michael Main.

Attorney Betters, representing the petitioner, reviewed the petition as presented to the Planning Board and the suggested changes.  The fitness center and the pool will be connected by a breezeway.  The property is located at the end of Cedarhill Drive.  The original submission to the Board of Appeals depicted 157 parking spaces.  The Planning Board requested parking be reduced.  The petitioner would like to eliminate two spaces for a total of 155 spaces.

Mr. Hensen, Landscape Architect, said that the entrance will be landscaped.  The wooded area between Route 3 and the building will remain.

Attorney Betters, reviewed the difference in the plans submitted to the Board and the schematic created in response to the Planning Board’s request for the reduction in parking.  The final plans will depict the number of spaces and the petitioner will return to the Board for final approval.

Case No. 3381 – Philip Lewis – Haskins Street/off McKay Street

Mr. Richard read the legal advertisement into the record.

Attorney Angley, representing the petitioner referred to a written presentation.

A long discussion ensued regarding the road improvements that were required by the petitioner of a previously granted special permit on McKay  and Haskin Streets.

Case No. 3380 – Tom and Robyn Crehan – Allen Court

Sitting: Peter Conner, Robert Richard, William Keohan, David Peck, and Michael Main.

Mr. Richard read the legal advertisement and a letter of support into the record.

Mr. Crehan said that he would like to construct a 14’ x 26’ addition to the side of his house facing South Street.  He also stated that he constructed a shed without permits that he would like to bring into compliance.  The shed is located 4.4’ from the lot line.  Two additional letters of support from neighbors were submitted for the record.

INFORMAL MATTER

Case No. 3302 - Waterhouse, LLC – Crow’s Way

Sitting: Peter Conner, Robert Richard, William Keohan, David Peck, and Michael Main.

Board discussed the letter dated August 4, 2006 from Henry Stout, Atlantic Properties, regarding the payment schedule for the $.06 per cubic yards of gravel removed from the site.   The terms of the letter were not acceptable to the Board.

Mr. Peck made a motion to collect the $24,000.00 gift on or before August 30, 2007 or upon completion of the earth removal project whichever comes first.

Mr. Richard seconded.

Unanimous.
VOTES:

Mr. Richard made a motion to approve Case No. 3373 with conditions.

Mr. Main seconded.

Mr. Peck made a motion to approve Case No. 3381 with conditions.

Mr. Main seconded.

Case No. 3380 – Tom and Robyn Crehan – Allen Court

Mr. Richard made a motion to approve the addition.

Mr. Peck seconded.

Unanimously granted.

Mr. Peck made a motion to approve the post facto shed

Mr. Keohan seconded.

Denied 2–3  Mr. Conner, Mr. Richard and Mr. Main in opposition.

No further business came before the Board.
