Zoning Board of Appeals Minutes June 21, 2006

MEMBERS PRESENT: Peter Conner, David Peck, Robert Richard, Wendy Longo, and Michael Main.

MEMBERS ABSENT: Patrick Mulvey-Welsh and William Sims (both resigned)

Mr. Conner called the meeting to order and explained the procedures for the evening.  

Case No. 3370 – Robert Gosselin, Goscon Inc. – Warren Avenue

Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Michael Main.

Mr. Richard read the legal advertisement and the letter requesting to withdraw into the record.

Mr. Longo made a motion to allow the petitioner to withdraw the petition.

Mr. Richard seconded.

Unanimously withdrawn.

Case No. 3372 – Leonard Horsford – State Road

Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Michael Main.

Mr. Richard read legal advertisement into the record.

Mr. Esposito, Outback Engineering, said that the petitioner would like to construct a duplex on the site.  No lawn area is proposed.  No parking spaces were delineated on the plans.  Each unit will have a separate Title V Septic System.

Mr. Richard asked the petitioner if the sight line was check and if not, he would like that done.

Mr. Esposito replied that the site was at the crest of the hill and that the sight distance was not a problem.

No public comment was offered in favor.

Mr. Esposito said that the 100’ setback could be achieved by setting the dwelling to the north.  By doing that the dwelling would be closer to the wetlands and the north lot line.

Mr. Conner asked the petitioner if moving the building to the north would affect the parking.

Mr. Esposito replied that it could.

Case No. 3371 – Lawrence Gay – Court Street

Sitting: Peter Conner, David Peck, Robert Richard, Wendy Longo, and Michael Main.

Mr. Richard read the legal advertisement into the record.

Attorney Angley referred to a written presentation.

Mr. Henson, The Henson-Fuller Group, reviewed the site and surrounding locations.  The site is a little over an acre.  Eight units are proposed.  There will be a modification of the existing curb cut within the same curb cut.  Water will be a feature of the site.  Each unit will have a garage. The site has Town utilities.  Enhanced plantings will be used.  The wetlands will be replicated.  A public access could be an interconnected open space system.    The access will be a paver system.

Mr. Gay said that the water level does not change.

Mr. Bracken, Bracken Engineering, said that he had worked in the area and that the water level has not changed since the 1980’s.

Case No. 3065 – Gladstone Development – Hedge Road

Sitting: Peter Conner, David Peck, Robert Richard, Wendy Longo, and Michael Main.

Attorney Winokur said that the client was here tonight requesting approval of Conditions 1 & 2.  This case was granted several years ago and was appealed by an abutter.  The case has now been dismissed.

Mr. Bracken, Bracken Engineering, referred to the changes on the plans as required in both conditions.

Mr. Longo made a motion to accept Conditions 1 & 2 as complete.

Mr. Main seconded.

Unanimously accepted.
VOTES:

Case No. 3372– Leonard Horsford – State Road

Mr. Richard made a motion to deny without prejudice Case No. 3372.

Mr. Main seconded.

Unanimously denied.

Case No. 3371 – Lawrence Gay – Court Street

Mr. Main made a motion to approve with conditions.

Mrs. Longo seconded.

Granted 4-1.  Mr. Richard opposed.

No further business came before the Board.
