Mr. Conner called the meeting to order and explained the procedures for the evening.
Case No. 3350 – Pinehills Village Condominium – Beaver Dam Road – continued from March 15, 2006
Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Michael Main.
Mr. Parker, Land Management Systems, said that he would like to proceed with the chronology of events that have lead up to the meeting.
Mr. Conner asked the petitioner if he was prepared to move forward.
Mr. Parker replied that he was not ready to move forward but that he wanted to honor his agreement with the Planning Board and request a continuance.
Mr. Conner said that the Board granted the petitioner a three month continuance and that at this time you should be ready to move forward. The policy of the Board is to grant one continuance and if the petitioner is not ready to proceed at that time the petition can be withdrawn or denied without prejudice.
Mr. Main made a motion to deny without prejudice.
Mr. Richard seconded.
Unanimously denied.
Case No. 3367 – Hamlin Properties – Court Street
Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Michael Main.
Mr. Richard read legal advertisement into the record.
Attorney Cornetta, representing the petitioner referred to a written presentation on file in the ZBA office. The petitioner met with the North Plymouth Steering Committee. The proposal is for 5 residential units in four buildings and a retail building at the front of the lot.
Mr. Conner asked the petitioner if he had a recommendation from the North Plymouth Steering Committee.
Attorney Cornetta replied that he did not.
Mrs. Hamlin replied from the audience that the recommendation was sent to the Planning Board.
Mr. DeBenedictis, DeBenedictis-Peterson Associates, said that the buildings were 39 feet high and that the issue of height came up at the Planning Board meeting. The petitioner can lower the buildings if necessary. The buildings were raised to give light to the lower level. The drainage system is in the parking lot. There is a retaining wall at the back of the property but it is on another site. The petitioner wanted a court yard setting. There will be 25 parking spaces. Plants have not been identified.
Mr. Conner asked the petitioner why the prior two applications were never built.
Mr. DeBenedictis replied that it was too costly because of the sewer design. The property can hook up to Town sewer and water now.
Mr. Conner asked the petitioner why the parking spaces are 9’x18’ instead of 10’x18’.
Mr. DeBenedictis replied that the petitioner could make the spaces 10’x18’ but would lose spaces.
Mr. Peck said that the site is too dense and was uneasy with the trash situation. No place to put snow.
No public comment was offered.
Attorney Cornetta asked that the Board give the petitioner direction on a continuation.
Mr. Richard asked the petitioner if he considered downsizing the project so the dumpster and parking spaces can fit.
Attorney Cornetta replied that the petitioner would look into it but that he would like to proceed with the current configuration.

Case No. 3369 – Reliable Fish – Town Wharf

Attorney Angley referred to a written presentation.
Mr. Henson, The Henson-Fuller Group, reviewed the site and surrounding business locations. A pedestrian access will surround the building. The dumpster will be screened and gated. The pavement will be softened with planters.
Mr. Fornacari, Fornacari and Noseworthy, reviewed the design of the building. The height of the building is 33 feet.
