Zoning Board of Appeals Minutes July 19, 2006
MEMBERS PRESENT: Peter Conner, David Peck, Robert Richard, Wendy Longo, Bill Keohan, Michael Main, and Marc Betti.

Mr. Conner called the meeting to order and explained the procedures for the evening.

Presentation on including the Inclusionary Housing Section of the Bylaw into the Required Information section of the ZBA petition.  

Case No. 3376 – Plymouth Property Owners – State Road

Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Bill Keohan.

Mr. Richard read the legal advertisement and request for a continuance into the record.

Mr. Shaw, Associated Engineers, representing the petitioner, said that his client was requesting the continuance in order to provide the Planning Board with additional information.  This information includes final landscaping plans, architectural plans, and Memorandums of Understanding.   

Mr. Richard asked the petitioner why he did not have this done before he filed with the Board of Appeals.

Mr. Shaw replied that this project has been in the planning phase for over two years and that the petitioner filed for a Master Planned project knowing they would have to return with final plans.  The Planning Board has requested that the plans be presented before they make a recommendation.
Mr. Peck made a motion to allow the petitioner to continue this case to October 4, 2006 at 7:30 p.m.

Mrs. Longo seconded motion and said if they are not ready to proceed at that time they would be asked to withdraw the petition and re-file when they are ready to proceed.

Unanimously continued.

Case No. 3363 – Omnipoint Communications – Cedar Street/off White Island Road

Sitting: Peter Conner, Robert Richard, A. Wendy Longo, and Michael Main.

Mr. Conner told the audience that this case was continued to give the petitioner time to correct what the Board believed was a flawed legal advertisement.  The petitioner never responded to the request and did not appear at the hearing.

Mr. Richard made a motion to deny Case No. 3363.

Mr. Main seconded.

Unanimously denied.

Other Business

A discussion ensued regarding the process.  

Mr. Richard said too many petitioners are requesting continuances after filing with the Board of Appeals based on the requests of  the Planning Board.

Mr. Conner agreed and said he would send a memo to the Chairman of the Planning Board.

Mr. Richard said that he is not going to consider continuing cases based on delay getting through the Planning Board process.

No further business came before the Board.
