Mr. Conner called the meeting to order and explained the procedures for the evening.
Case No. 3340 – McDonald’s Corporation – Samoset Street

Mr. Welsh read the legal advertisement into the record.
Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.
The petitioner would like to demolish the existing building and constrict a smaller new building.
Al Micale, Ayoub Engineering, reviewed the parking and circulation flow of the traffic. The access is not changing. The parking will exceed the requirements of the Bylaw. The new building will have a double drive-thru. There will be a bypass lane in the front of the building so you do not have to go out to Samoset Street if you can’t park.
Attorney Angley said that the Planning and DPW staff made some suggestions on changes to the project. Some were considered and others were not.
Mr. Micale reviewed the changes to the plans. Some of the parking spaces were eliminated, more green space was added. A stop sig was added. The curb was configured to force cars to turn left. A trench drain was added at the driveway. A dry line will be installed for a future sewer system. Trees were added to the landscaping.
Mrs. Longo asked the petitioner if the handicapped ramps were in front of the spaces.
Mr. Micale replied that they were.

Case No. 3339 – Davison Partners – Cranberry Road

Mr. Welsh read the legal advertisement and letter from Attorney Serkey requesting a continuance into the record.
Mr. Sims made a motion to continued Case No. 3339 to April 5, 2006 at 8:00 p.m.
Mr. Welsh seconded.

Case No. 3249 – Mark Liddell – South Street
Mr. Flaherty, representing the petitioner, said that one of the conditions of the decision required that the retaining be “stone or stone veneer”. The petitioner researched veneer walls and was told that the type of wall he installed was a veneer wall.
A long discussion ensued between Board members regarding the difference between stone and veneer look.
Mr. Longo made a motion that the wall was not a substantial change.
Mr. Main seconded.
Granted 4-1 Mr. Welsh opposed.

Mr. Sims made a motion to approve Case No. 3340 with conditions.

Case No. 3341 – John J. Downey – Allen Drive

Attorney Kwessel, representing the petitioner, said that the lot is not in contiguous ownership as stated in the Planning Board report. In 1984 the subject lot was sold. A petitioner requires a variance of area, depth, and width in order to construct a 768-sq. ft. house.
