Zoning Board of Appeals Minutes August 2, 2006
MEMBERS PRESENT: Peter Conner, David Peck, Robert Richard, Wendy Longo, Michael Main, and Marc Betti.

MEMBER ABSENT: Bill Keohan

Mr. Conner called the meeting to order and explained the procedures for the evening.  

Case No. 3362 – Herbert M. Jacobs – Highland Avenue – continued from May 17, 2006

Sitting: Peter Conner, David Peck, Robert Richard, A. Wendy Longo, and Michael Main.

Attorney Serkey, representing the petitioner, referred to a written presentation on file in the ZBA office.

Mr. Kotowski, Webby Engineering, said that the plan that was submitted in 2004 had different access.  The Town is seeking an easement.  All of Highland Avenue was surveyed.  A clay layer was found at Manomet and Highland Ave.  A common driveway will service both lots.  The Town requested that the petitioner elevate the drainage problem that has existed for years.  

No public comment was offered in favor.

Mr. Kotowski said that he believed the drainage systems would make the problems down there much better.

Attorney Serkey reviewed the remainder of the written presentation.

Case No. 3378 – SRW Contractors’ Supply – Robert J. Way

Sitting: Peter Conner, Robert Richard, A. Wendy Longo, David Peck, and Marc Betti.

Mr. Richard read the legal advertisement into the record.

Mr. Shaw, Associated Engineers, said that the permit that was issued a little over two years ago expired. The petition is exactly the same.

No public comment.

Hearing closed.   

Mr. Conner asked the Board for a Roll Call vote to enter Executive Session.  

Robert Richard – yes
Michael Main – yes
Peter Conner – yes.

Mr. Conner announced that the Board would return to open session.

Back in session.
VOTE:

Case No. 3378 – SRW Contractors’ Supply – Robert J. Way

Mrs. Longo made a motion to grant Case No. 3378.

Mr. Richard seconded.

Unanimously granted.

Mr. Conner asked the Board for a Roll Call vote to enter Executive Session. Second time.

Mr. Conner again announced that the Board would return to open session.

Back in session –

Case No. 3329 – Twin Pines Farm – Carver Road

Sitting: A. Wendy Longo, Robert Richard, and Michael Main.

Attorney Stearns said that there were no site distance problems.  The changes that were made did not affect the site distances.  

Mr. Conner asked if there was a letter or some certification that the site distances were not changed.

Attorney Stearns replied that the petitioner could obtain a letter from the Traffic Engineer stating the site distance had not changed.

Mrs. Longo said that she would like a letter from a qualified engineer because the Board was not qualified to determine the site distances.

Attorney Stearns said that the petitioner would like to put up a split rail fence.

The Board was of the opinion that the split rail fence was acceptable.

Attorney Stearns provided the Board with samples of the siding and trim for the record.  Attorney Stearns closed in stating that progress has been made.
VOTE:

Case No. 3362 – Herbert M. Jacobs – Highland Avenue

Mrs. Longo made a motion to approve Case No. 3362 with conditions.

Mr. Richard seconded.

Unanimously granted.

No further business came before the Board.
