Zoning Board of Appeals Minutes April 12, 2006
MEMBERS PRESENT: Peter Conner, Bill Sims, Patrick Mulvey-Welsh, Michael Main, Robert Richard, Wendy Longo, and David Peck.

Mr. Conner called the meeting to order and explained the procedures for the evening.  

Case No. 3354 – Stephen L. Thomas, Jr. – Robert J. Way  

Sitting: Peter Conner, Patrick Mulvey-Welsh, Robert Richard, Wendy Longo, and Michael Main.

Mr. Richard read the legal advertisement into the record.

Attorney Betters, representing the petitioner said that Robert J. Way is a newly constructed roadway.  The petitioner is proposing to open a motorcycle repair, parts and accessories business.  The use is appropriate in the zone.  The petitioner has no problem with the license for the waste removal being on file.

Mr. Main asked the petitioner if there was going to be painting on site.

Mr. Thomas replied that there would not be.

No public comment.

VOTE:

Mr. Main made a motion to approve Case No. 3354 with conditions.

Mr. Mulvey-Welsh seconded

Unanimously granted.

Case No. 3356 – Pau Carpilio – Industrial Park Road

Sitting: Peter Conner, Bill Sims, Bob Richard, Patrick Mulvey-Welsh, and Wendy Longo.

Mr. Richard read the legal advertisement into the record.

Attorney Betters, representing the petitioner said that the petitioner is proposing to open a deli/food service/restaurant business.  The parking relief is not required.  The property is on Town water and sewer.

No public comment.

Case No. 3355– Four OC LLC – Commerce Way, Resnik Road, and Christa A. McAuliffe Blvd.

Sitting: Peter Conner, Bill Sims, Bob Richard, Patrick Mulvey-Welsh, and Wendy Longo.

Attorney Betters, representing the petitioner said that the property is across from Colony Place.  The petitioner plans to develop the site in phases.  The total retail/office will be 36,000-sq. ft. in five separate buildings.  The retaining wall has been reduced to 12’ all the way.

Mr. Shaw, Associated Engineers, said that there will be three curb cuts, one on Commerce Way, one on Christa McAuliffe, and one on Resnik Road.  

Jeff Dirk, Vanasse & Assoc., reviewed the traffic.  All of the development in the area was looked at.  Crash volume at Route 80 should be reduced with the traffic signal.

Mr. Betters reviewed the conditions.

Mr. Richard made a motion to grant Case No. 3355.

Mrs. Longo seconded.

Unanimously granted.

No further business came before the Board.
