Planning Board Minutes October 24, 2011

        Town Meeting Articles
Mr. Garrett opened the meeting.
The Board received the following documentation regarding proposed amendments to the following Town Meeting Articles:*
Article 18 amendment language from Advisory and Finance Committee
Memo dated 10/19/2011 re:  Article 17 Amendments
Draft Section 205-57 and Table of Zoning Bylaw
Mr. Hartmann noted that an amendment was offer on the floor of the April 2011 Annual Town Meeting to Article 41.~ The amendment requires a 100 wide buffer between car dealerships and residential zones. He noted that the Advisory and Finance Committee and the Board of Selectmen support this amendment.~ He recommended that the Board also vote to support this amendment to Article 18 for tonight’s Town Meeting.

Acting on the Motion of Mr. Rosenblum the Board voted unanimously (5-0) to support the following amendment: “to amend section 205-55 by adding the following language at the end of subsection D (9), For a special permit for a licensed new car franchise dealer under this section and in lieu of the requirements of Section 205-21 A(2)(a), a buffer strip of a minimum of 100 feet shall be required. The buffer strip shall include screening adequate for the situation and characteristics of use and shall be retained or provided for in the form of a planted earthen berm, thick plantings, walls, fences or any combination thereof, as required by the special permit granting authority”.

Mr. Hartmann noted that during the public review process for Article 17 (Aquifer Protection). ~The following three amendments have been suggested:~
Article IV, Section 205-57.~ Aquifer Protection District (AA).
  • To add:
D. (10) Municipal Sewerage System – A public sewerage system operated by a municipality, or a privately owned and operated sewerage treatment plant duly licensed by the DEP pursuant to requirements of the Massachusetts Clean Waters Act and the regulations adopted under 314 CMR 1.00 through 9.00.
  • And to re-number the remainder of Paragraph D thereafter.
  • To change sentence within Paragraph H (5) (b):
H. (5) (b) If within forty five (45) days after submittal the ~Director of Inspectional Services has not disapproved the submitted well locations, program and schedule, or a mutually agreed upon extension of time has not been reached, the monitoring wells and sampling program shall be not required deemed approved.
And, within Section 205-57. Aquifer Protection District (AA) Use Table.
  • To add, on Page 3:~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ ~~~~~~~ Area I~ Area II~ Area III
The storage of more than 5,000 gallons of gasoline, oil or similar petroleum products.

He noted that the amendments are basically clarifications that are in keeping with the intent of the article.~ He recommended that the Planning Board support the amendments.

Acting on the motion of Mr. McAlduff the Board voted unanimously (5-0) to support the proposed amendments.
