BOA 3634 – William Ellis
        5 Water Street/Map 20, Lot 121
The Board recommended approval to the Zoning Board of Appeals for a Special Permit for a minor repair shop in a DH zone.

Tim Grandy moved for the Board to approve the Administrative Notes as presented; the vote was unanimous (4-0).

Larry Rosenblum moved for the Board to waive the rules of appointment in order to appoint Mr. McGuinness to fill the vacant position created by the resignation of Dennis Lassige; the vote was unanimous (4-0).

Mr. Garrett thanked all the applicants for their interest and willingness to serve.

BOA 3633 – Industrial Tower and Wireless LLC
        109R Center Hill Road/Map 52, Lot 6I
        Special Permits subject to EDC for a communication tower and to exceed the height requirements (6/29)
Mr. Garrett stated that this review will not be completed this evening and be continued to June 20, 2011.  A statement will be made by the attorney for the abutters after the presentation by the petitioner and his/her representatives.  Staff is waiting for additional information.
Atty. Edward Angley and Kevin Delaney, Industrial Tower and Wireless LLC presented the request for a special permit in order to construct a 150 ft. monopole communication tower at 109R Center Hill Road.  The five acre site is heavily wooded and the tower would be located approximately 750 ft from Center Hill Road.  There will be one utility pole at the entrance to Center Hill Road with the remainder of utilities (electric, phone and fiber optic) underground.  The 60’x80’ compound will be surrounded by an 8 ft. chain link fence and will house the pole, shelters and cabinets, generator and propane tank.  A locked security gate will be installed to prevent vehicle access.  Mr. Delaney presented maps showing the existing wireless coverage in the area and proposed coverage that would fill the gap in this area.  A previous submittal which was withdrawn showed a lattice tower of 180 ft.   Radiation output will be in compliance with Federal Telecommunication Act guidelines.  AT & T has submitted a letter of interest to locate an antenna on the monopole.  Nine alternative sites were considered, but the applicant was not able to come to terms with the owners.   
Valerie Massard stated that staff has not received all the information necessary to produce a full staff report.  The Cedarville Steering Committee and Airport Commission have not submitted comments and the town’s consultant is in the process of reviewing response comments from Industrial Tower and Wireless LLC.   
Larry Rosenblum asked if any studies were done on the visual impacts to the surrounding area.
Atty. Angley stated that no visual studies have been done.  
Mr. Garrett asked whether any site more inland were considered as a significant portion of the proposed coverage is out in the bay.   He also asked if another antenna could be added to an existing tower to increase coverage.  
Mr. Delaney replied that an overlap of existing coverage is not preferable as it would waste the resource.     
Tim Grandy asked how the sound evaluation was done on this site and whether the town’s consultant would be reviewing sound impacts.
Mr. Delaney stated that an independent company did a sound evaluation and that there would be a +7db increase in one location, but as you get further away the sound dissipates.  He noted that the generator will have a hospital grade muffler system and the HVAC will only come on certain times of the year and the sound will be below accepted industry standards.  The generator will cycle on for a half hour once a week.  
Ms. Massard stated that the town’s consultant is looking at the wireless component not sound impacts.  
Atty. Richard Serkey, representing several abutters stated that he would be submitting petitions signed in opposition at the next meeting.  A PowerPoint presentation will be reviewed by the Cedarville Steering Committee at their next meeting.  Atty. Serkey noted that legal standards have to be met before the Zoning Board of Appeals can grant a special permit to exceed the height requirements.  Atty. Serkey stated that the petition does not offer a clear and specific benefit as existing towers provide a feasible alternative and there would be a substantial visual impact on the character of the neighborhood.   There is also concern that this would be a commercial enterprise in a residential area.  
Mr. Garrett asked if there is any history of commercial use in an RR zone.
Lee Hartmann stated that the Federal Telecommunication Act can override the local standards if a need for wireless coverage is demonstrated and there is no feasible alternative.  Mr. Hartmann stated that petitioners are encouraged to review alternatives, co-location, and demonstrate that other carriers are ready to utilize the communication tower.  
Larry Rosenblum moved for the Board to continue their review of BOA 3633 to June 20, 2011 at 7:30 p.m.; the vote was unanimous (4-0).  

Other Business:

Larry Rosenblum announced that there will be an Intermodal Transportation Siting Study meeting on Wednesday, June 8, 2011 at 7:00 p.m. at the Plymouth Art Center on North Street.   

Tim Grandy moved to adjourn at 8:19 p.m.; the vote was unanimous (4-0)
