        MINUTES OF THE MEETING
        December 16, 2014

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, December 16, 2014 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners, Joshua Bows, Frank Drollett, David Foster and John Moran.  The secretary Michelle Turner was also present.
The Conservation Planner Richard Vacca was absent.

Administrative Business – May include topics not reasonably anticipated by the Chair 48 hours in advance of the meeting

7:00 PM     Robert and Rosemarie O. Daniello, 6 Ice House Road, Parcel ID 098-000-092-002.  A Notice of Intent to construct a new carport over an existing asphalt driveway, a new storage unit, and add to an existing deck, within the buffer zone of Billington Sea.  
A waiver is requested to work within the 35-50 foot buffer zone.
This project may be subject to review by the Natural Heritage and Endangered Species Program and MESA.

Russell Stefani of Flaherty & Stefani, Inc. represented the applicant and explained the project.
Coil rolls will be used. Pavement already exists and they propose to repave.
No NHESP response received to date.
No public comment made.
David Foster motioned to approve the project with conditions, including receipt of NHESP response and any conditions they may impose.  Approved unanimously.

7:10 PM    Russell and Jody Frederickson, 29 King Philip Road, Parcel ID 053-000-020-023.  A Notice of Intent to make improvements to a single family dwelling, including an addition, elevated deck construction, deck replacement, retaining walls, fencing, and landscape plantings in the buffer zone and resource of a coastal bank.  
A waiver is requested to work within the 35-50 foot buffer zone.

Brad Holmes of Environmental Consulting and Restoration (ECR) represented the applicant and explained the project.
Attorney Richard Serkey was also present and professional landscaper Adam Pizzi was also present.
Brad Holmes began the presentation by noting the resource areas (coastal bank and top of coastal bank).
He described the existing site plan.

Attorney Serkey explained the proposed work.
The 2 dwelling additions
Elevated deck construction – new 10 x 15 elevated deck
Deck replacement – existing to the same dimension (footprint)
Landscape retaining walls along the eastern property line that would allow a grade change to make the back yard more usable.
Landscape plantings in the buffer zone
Retaining walls at the top of the yard near the street
Coastal bank invasive species – some will be pruned and removed.
No tree removal is proposed.
Removal of surface tires on the bank.

Chairwoman Strawn expressed concern regarding the retaining wall on the easterly property line.

Adam Pizzi, landscape contractor, described the height of the wall averaging 8 and 10 feet high, located 2 feet in from the property line.

Discussion ensued over the deck proposed within the 35 ft. no touch buffer zone.

A flag pole was also requested but Gerre Hooker was not supportive of the location of the pole

Josh Bows also had concern with the proposed retaining walls on the property line.  Josh’s opinion was that this was too large a disturbance within the 35 ft. no-touch buffer zone, for a waiver request, in order for the property owner to maintain additional lawn area.  Discussion ensued on the wall.

Gerre asked about the walkway – permeable pavers would be used.  Coastal stairs go to the beach
Gerre asked about what would happen when the tires are removed.  Brad said sand and beach grass would be added.

David Foster did not support a waiver request for the work proposed in the 35 ft. buffer zone – retaining walls and deck


Public Comment:
Steve and Dawn Dow, 31 King Philip Road  - expressed concern with adding more areas of potential erosion and runoff to the site.

Consensus was that the representatives needed to take back the above concerns to the homeowners.
Gerre Hooker motioned to continue the hearing to January 13, 2015 at 7:20 PM.  Approved unanimously.

ORDERS OF CONDITIONS:
SE57-2742 Kathleen Mahoney, 1 Sandy Beach Road, Parcel ID 120-000-021-000.  A Notice of Intent to demolish the existing dwelling and construct a new dwelling on the existing foundation, including utilities and amenities and to permit the existing seasonal dock, within the buffer zone and resource of White Island Pond.
Gerre Hooker motioned to approve the OOC as written.  Approved unanimously.


SE57-2741 Absolute Building Consultants, Inc., 41 Livingston Drive, Parcel ID 059-000-027-009.  A Notice of Intent to construct a stairway and a seasonal dock to access Island Pond.  A waiver is requested to work within the 35-foot no-touch buffer zone.
David Foster motioned to approve the OOC as written.  Approved unanimously.


CERTIFICATE OF COMPLIANCE:
SE57-2468 – Rosemont Realty Trust – Partial Release for 279 Manomet Point Road ONLY (since NO work occurred on this site).
Gerre Hooker motioned to issue the COC.  Approved unanimously.

EXTENSION PERMITS: NO ACTION TAKEN AT THIS TIME.
SE57-2253, William Harrington, 85 Ellisville Road, new single family dwelling w/coastal stone revetment
