MINUTES OF THE MEETING
November 29, 2011
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone and John Scagliarini. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
David Foster, Brooke Monroe and Paul Withington were absent

7:30 PM Peter L. Ebb & Frances Green, 1 Boat House Lane, Parcel ID No. 046-000A-122A-000. A Request for Determination of Applicability for coastal erosion repairs of the public boat ramp and adjacent private property including stone, cobble, chink stone, and repair of the existing fence, within the resource and buffer zone of a coastal bank
J. Randolph Parker of LMSI represented the applicant and explained the project. He explained how the wave action from northeast storms comes up the boat ramp and causing erosion to the ramp as well as the Ebb property (yard, fence and fence posts). This applicant is willing to perform the repair to the boat ramp, also. Additional rock and concrete around the fence footing is needed. Additional cobble and stone would be set in concrete would also be added to the ramp apron. Applicant also requests to add chink stones to the face of the original wall. Mr. Parker supported the Commission to add a condition regarding no mortaring the face of the existing stone revetment.
Public Comment:
Paul Francis, 164 Manomet Avenue. Supported the project but asked if there would be a change in elevation of the ramp. Mr. Parker said it would remain sloped 15 – 20 degrees, and curved upward to meet the grass area.
Public comment closed.
Gerre Hooker motioned to issue a negative determination, with a condition of no mortar on the face of the existing revetment. Approved unanimously.
7:40 PM Leif & Diane Gillbert, 379 Federal Furnace Road, Parcel ID No. 095-000-051-000.
A Notice of Intent for the placement of a seasonal dock within the resource of Big West Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Andrew Harmon represented the applicant.
John Scagliarini motioned to approve the project with conditions. Approved unanimously.
7:45 PM Joseph & Amy Davies, 72 Vine Brook Road, Parcel ID No. 045-000-002-176.
A Notice of Intent to demolish the existing single family dwelling and construct a new single family dwelling including utilities, amenities and site work within the buffer zone of the top of inland bank of Bartlett Pond. The applicant also requests a waiver under the Plymouth Wetland Bylaw for proposed work within the 35 ft. no touch zone and 50 ft. no-build zone.
Don Bracken of Bracken Engineering represented the applicant and explained the project.
11000 sq. ft. lot. existing dwelling built 1950. The Current dwelling falls within the 35 and 50 ft. buffer zones. Mean high water is located on the plan. Resources include coastal flood zones, bordering vegetated wetland and coastal bank. Upper most resource area is coastal bank. Approximately 400 sq. feet additional living space is proposed within the 35-50 ft. buffer zones. Dwelling is currently 11 ft. to coastal bank; the new dwelling is proposed 19 feet. No change to the septic system is proposed as it was upgraded in 2001. Variance of BOH from foundation to ss will be sought. Impervious barrier will be needed around the foundation. Full foundation is proposed.
James Aimone supported the project and the waiver. He agreed the dwelling is modest and there is no change to the septic system.
John Scagliarini supported the waiver to allow the work in the 35-50 buffer zone.

Commission acknowledged the 2 existing seasonal docks.
Don Bracken revised the plan, at the table, to include a siltation/limit of work line.
James Aimone motioned to approve the project with conditions. Approved unanimously.
8:00 PM Christopher R. Healy, 15 Bayberry Road, Parcel ID No. 050-004-008-000.
A Request for Determination of Applicability to upgrade a septic system in the buffer zone of the top of a coastal bank.
Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the upgrade. Tank proposed approximately 32 ft. from top of coastal bank.
No public comment made.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
8:05 PM Michael F. Scully & Dianne Sferruzza-Scully, 6 Sunset Boulevard, Parcel ID No. 120-035A-003-458. A Notice of Intent to demolition a portion of the existing dwelling and construct a new 1-car garage with addition above; reconstruct the existing deck and stairs, construct new well and new septic system, in the buffer zone of White Island Pond.
Mark Flaherty of Flaherty & Stefani, Inc. and the homeowner, Michael Scully were present.
Mark Flaherty described the project. BVW exists on the site. Bob Gray of Sabatia flagged the wetland.
Only small amount of the existing deck is in the 35 ft. buffer zone, to be rebuilt in the same footprint. Septic system will be upgraded.
No public comment made.
John Scagliarini motioned to approve the project with conditions. Approved unanimously.
Other: Business:
ACTION ITEMS:
Review complaint at 91 Sea View Drive regarding construction of a chicken coop within 35 ft. buffer zone. Randy Parker represented the homeowner, Mr. Gwilliams, who was not present.
Conservation staff, Liz Sullivan gave some history of the complaint filed with the office. Staff’s recommendation was that in part it was a replacement of the old chicken coop (to be demolished after the new construction), although the new construction would be a larger replacement. Staff considered the work non-invasive and expected no impact to the resource (top of coastal bank).
The neighboring property owners, Daniel and Caroline Harrington of 93 Seaview Drive, asked the Commission to consider the cumulative impact to all activities currently existing in this buffer zone. They had great concern with the proximity of the new enlarged structure to the bank.
Consensus of the Commission was that the new construction posed no impact to the Coastal Bank and would not require a filing under the Wetlands Protection Act, however the project may be subject to building and zoning regulation.
