MINUTES OF THE MEETING
September 13, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, September 13, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe, John Scagliarini and Paul Withington.  The secretary, Michelle Turner, was present.
Chairwoman Evelyn Strawn was absent.

Continued from August 9, 2011
7:30 PM Ronald F. & Ann G. Dobrowski, 36 Massasoit Avenue, Parcel ID No. 049-001-001-000.  A Notice of Intent to demolish the existing single family dwelling, construct a new single family dwelling with amenities and utilities in the buffer zone of the top of a coastal bank.  Applicant also requests a waiver under the Plymouth Wetland Bylaw for construction within the 50 ft. no-build zone and for site work within the 35 ft. no-touch zone.  

Donald Bracken of Bracken Engineering represented the applicant and explained how the plan has been revised:  septic system was moved closer to the road, retaining wall added, converted free standing garage to a shed (so that a 10 ft. setback from the septic system need not be maintained).  Dwelling was pulled back so that all construction is outside of the 50 feet buffer zone.
No public comment.
James Aimone motioned to approve the project as proposed including allowing vista pruning within the 35 ft. no-touch buffer zone.  Approved unanimously.

7:40 PM Florence B. Burkett Realty Trust, Saquish Beach, Parcel ID No. 132-000B-250-000.   A Request for Determination of Applicability to construct a screened porch above a portion of an existing deck, in the resource of a coastal dune and beach of Saquish Beach.
Florence Burkett was present and explained her project.
Brooke Monroe motioned to issue a negative determination.  Approved unanimously


7:45 PM Richard Potter, 166 Black Cat Road, Parcel ID No. 098-000-069B-000Z.  A Request for Determination of Applicability to construct a new septic system in the buffer zone of a bordering vegetated wetland of Billington Sea and Trask Pond.

Mark Flaherty of Flaherty &Stefani, Inc., represented the applicant and explained the project.  
Commission acknowledged the seasonal dock on site and will require the applicant to seek if a Chapter 91 license is required.
John Scagliarini motioned to issue a negative determination.  Approved unanimously.

7:50 PM Cathy Lennon, 12 Goldfinch Lane, Parcel ID No. 096-000-039-000.  A Request for Determination of Applicability to construct a new septic system in the buffer zone of Micajah Pond.

Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project.  Access to the site is the most difficult part of the project with wells located on two sides of the property.
James Aimone motioned to issue a negative determination. Approved unanimously.

7:55 PM Daniel Green, Five Lanterns, Parcel ID Nos. 078C-000-000A-209; 078C-000-000A-210; 078C-000-000A-211.  A Request for Determination of Applicability for the removal and replacement of a portion of an existing paved roadway currently on Five Lanterns.  The new paved roadway will be part of a new condominium neighborhood called The Greens (consisting of three streets named Conifer Hill, Cupola Lane & Wren’s Nest).  No utility placement is associated with the roadway reconstruction.  All work is within the buffer zone of bordering vegetated wetlands of fallow cranberry bogs.

Kevin Sweatt, VHB, Daniel Green and Alan Green of GP Pines were also present.  
Impervious surface will be removed and replaced for the new roadway layout.  
All foundations for the new dwellings are proposed within the 50 ft. no-build buffer zone. Driveways and utilities are within the 35 ft. no touch.  The layout of the roadway and utilities were approved through a Conservation filing in 2007.
James Aimone motioned to issue a negative determination.  Approved unanimously.

Discussion:  Article 21 – Fall Annual Town Meeting – Affordable & Veterans Housing

Presentation by Lee Hartmann, Director of Planning & Development.  Mr. Hartmann discussed the project to construct 8 houses on a 35-acre tax-title site, for affordable/veteran housing.  Twenty-five acres would be reserved for permanently protected Open Space through a gift of land to the Conservation Commission.


Public Comment:
Neighbor, Ethan Warren, 878 Long Pond Road.  He had concern with placement of the dwellings on the site.  150 acres in the area are open space/conservation land.  Lot slopes toward the road and drainage runs to the bog across Long Pond Rd.   Proposed that the town could build a road into the site and set the houses off the road.  He believes the area is very sensitive and more protections should be in place.

Suzanne Lucas, 9 Bloody Pond Road.  Concern with the drainage at the base of the hill.

Michael Main, Proponent of the article, confirmed that all runoff would be contained on the lot.

James Aimone motioned to support Article 21 with condition that Conservation would have some control over how the development of the land would affect the Conservation-owned parcel.  Approved unanimously.


Violation: 54 Russell Mills Road – Doris Sears – Clearing and cutting the inland bank/bordering vegetated wetland of Russell Mills Pond.  Staff explained that the violation was called in by an environmental scientist doing research on the pond, for the Town.  Conservation/Planning staff member, Patrick Farah was also present.
Neighbor explained that this was a bank that had always been maintained in the past and due to Mr. Sears death a few years back, maintenance had ceased.
Marty Enos supported Mrs. Sears and asked the Commission to overturn the $50 fine that was issued.
Kevin Enos, also supported Mrs. Sears.
John Scagliarini motioned to support the Violation Notice and $50 fine, as issued.  Approved unanimously.


ORDERS OF CONDITIONS:
SE57-2556, Ronald & Ann Dobrowski, 26 Massasoit Avenue. Brook Monroe motioned to approve the Order as amended.  Approved unanimously.


CERTIFICATE OF COMPLIANCE:
SE57-1946, Duncan and Lisa Short, 489 Ship Pond Road.  In-ground swimming pool construction. John Scagliarini motioned to issue the COC.  Approved unanimously.

MINUTES:
August 23, 2011.  James Aimone motioned to approve as written.  Approved unanimously.
