MINUTES OF THE MEETING
August 9, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe. John Scagliarini and Paul Withington.  Staff member, Michelle Turner, was also present.

7:30 PM Peter J. & Marie L. Laursen, 66 Billington Sea Road, Parcel ID No. 098-000-038-000Z.  A Request for Determination of Applicability to upgrade a septic system in the buffer
zone to inland bank and bordering vegetated wetland of Billington Sea.
No presentation was required for this project.  
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:35 PM Suzanne Shorey Irrevocable Trust, 42 Shore Road, Parcel ID No. 056-000-071-007.  A Request for Determination of Applicability to install a new well and upgrade a septic system in the buffer zone of an inland bank of Great Herring Pond.
J. Randolph Parker of LMSI (Land Mgmt Systems, Inc) was available for questions.
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:40 PM Peter Amalfi, 55 Provincetown View Road, Parcel ID No. 049-002-009-000.  A Notice of Intent for the construction of coastal stairway with landings, in the resource of a coastal bank.
James Aimone disclosed that his brother owns the adjacent property, but he felt he could continue to be impartial.  The Commission agreed and the applicant agreed to allow Mr. Aimone to be part of the quorum for this hearing.
Mr. and Mrs. Peter Amalfi represented themselves and explained their project for coastal stair construction.
David Foster motioned to approve the project with conditions.  Approved unanimously.

7:50 PM Ronald F. & Ann G. Dobrowski, 36 Massasoit Avenue, Parcel ID No. 049-001-001-000.  A Notice of Intent to demolish the existing single family dwelling, construct a new single

family dwelling with amenities and utilities in the buffer zone of the top of a coastal bank.  Applicant also requests a waiver under the Plymouth Wetland Bylaw for construction within the 50 ft. no-build zone and for site work within the 35 ft. no-touch zone.  
Don Bracken of Bracken Engineering represented the applicant and explained the project.
Ron and Ann Dobrowski were also present.  Don explained the dwelling site and delineated the buffer zones of the site.  Proposal is to demolish old house and build new dwelling.  SAS will be outside the buffer zone but the tank will be just inside the buffer.  Retaining walls are proposed to accommodate for the grade changes on the site.
Waivers are requested from 35 and 50 ft. setback.  Revegetation is proposed The existing heavilty vegetated front area is not proposed to be removed but new vegetation is proposed.  
Drywell is proposed in the driveway area.  The freestanding garage will stay.  All of the heavy vegetation will remain onsite.  
Due to the slope changes, this is the reason that the house would have to remain, or retaining walls would be needed.
Discussion ensued to relocate the dwelling and decks outside of the 50 ft. buffer zone.  
Mr. Bracken agreed that he could move the dwelling foundation back 50 feet, but the decks would remain in the no-built zone.
Gerre Hooker could not support the project as proposed and suggested a smaller dwelling.  John Scagliarini felt the same.  David Foster suggested some deck alternatives.
David would like to see alternatives to the deck proposed.
No Public Comment.

The applicants agreed to a continuance.
James Aimone motioned to continue to September 13, 2011, time to be determined.  Approved unanimously.

8:05 PM Provincetown View Road LLC, Caroline Fritz, 129 Manomet Avenue, Parcel ID No. 048-049-389-000.  A Notice of Intent to demolish the existing single family dwelling and construct a new single family dwelling, with two additions and porches,  in the buffer zone of the top of a coastal bank. Applicant also requests a waiver under the Plymouth Wetland Bylaw for construction within the 50 ft. no-build zone and for site work within the 35 ft. no-touch zone.  

Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project.
Mark began with an explanation of the site and their reasons for the need of the size of the additions.  Mr. Flaherty stated that seawall repairs would be costly and the homeowner wanted a  more substantial home to justify these costs.  

Public Comment:
Sheila Sadler, 126 Manomet Avenue – concern with the size and the height of the additions.  
Russell Sadler, also concern with the bluffs and the excavation that could cause more erosion.

Amy Davies, 72 Vinebrook Road asked for a confirmation of what the commission would like to see in the 50 ft. buffer zone and outside of the buffer zone.


Malcolm MacGregor, 168 Jordan Road, stated the Plymouth Bylaw protected the disturbance of view sheds from a public way (Scenic Road)

Robert Leonard, 135 Manomet Avenue, asked about the remediation of the bluff and wall..

Mark Flaherty asked for a continuance to September 27 to speak with his clients.
The Commission agreed.

Gerre Hooker motioned to continue to September 27 at 7:30 PM.

Other Business:

ACTION ITEMS:
Letter dated July 27, 2011 from: Friends of Ellisville Marsh, Inc., requesting permission to control the spread of Spotted Knapweed (invasive) by clipping and removing blossoms to interrupt the seeding cycle.  All work will be done by hand.
Evelyn Strawn was familiar with the species and supported this effort.  The consensus of the Commission was support of the project.  No further action was taken.
