MINUTES OF THE MEETING
March 29, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM John V. and Love M. Fragola, 109B Taylor Avenue, Parcel ID No. 045C-000-074-000.  A Request for Determination of Applicability to construct a new septic system in the resource of a coastal dune system of White Horse Beach.
Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project to upgrade the system in a small lot.  
Gerre Hooker motioned to issue a negative determination.  Approved unanimouslyl.

7:35 PM Eight Mates Realty Trust, Maureen Sheehan, Trustee, 308 Rocky Pond Road Parcel ID Nos. 092-000-018-000; 092-000-019-000; 092-000-020-000.  A Notice of Intent to construct an addition to the existing dwelling with associated driveway, grading in the buffer zone of Bordering Vegetated Wetlands of Powder Horn Pond and septic system proposed outside of the buffer zone.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Joe Webby of Webby Engineering represented the applicant and stated he was aware of the bylaw.
Shawn Dahlen , contractor also represented the applicant and gave some history of the site and the reasons for the additions.  The dwelling sits very close to the pond and adding additions to the house make it impossible to keep them outside of the 35 ft. buffer zone.
Discussion ensued over the setbacks.
John Scagliarini asked the applicant to reconsider the design and motioned to continue the hearing to May 10 at 7:30 PM:  The applicant agreed with a continuance.  Approved unanimously.

7:45 PM Center Hill Limited Partnership, 64 Center Hill Road and 74 Center Hill Road, Parcel ID Nos. 052-000-004A-001 and 052-000-004A-002.  A Notice of Intent for the reconstruction of the existing sloping stone revetment, including stabilization above with fill and vegetation, on a coastal bank including beach nourishment.
Carlos Quintal of CAQ Engineering represented the applicant.  Carlos began his presentation with some history of the lot to show that in 1990 there was a seawall constructed over the entire lot under the Cahill name.
New topos show 40 feet of beach lost at south end and 20 feet lost at the top since 1995 (timeframe when CAQ started monitoring the bank).  Most of the bank is slumped due to rock getting behind it..
Gerre Hooker asked about the access areas for equipment.  She also asked about an earthen berm constructed at the top and the control of the rainwater runoff back onto the lawn area.  Carlos explained the access areas and  he said that the berms were not necessary.  Gerre asked about the house being moved back.  Carlos said that house would not be relocated.
No public comment.
Gerre Hooker motioned to approve subject to conditions.  John Scagliarini opposed.  Approved by a majority. 5 in favor/1 opposed.

8:00 PM William Silver, 25 Sea View Drive, Parcel ID No. 049-004-471-000Z.  A Notice of Intent to demolish the existing dwelling and construct a new dwelling, including septic system upgrade, utilities, amenities and stabilization, in the buffer zone of the top of a coastal bank.

Randy Parker of LMSI represented the applicant and explained the project.
Discussion ensued over the original site plan and asked the applicant to withdraw this new filing and request a field change under the old filing.  The applicant agreed.
Gerre Hooker motioned to allow a field change for DEP SE57-2367 to allow the dwelling to be demolished and accepted the plan dated 2-28-11.  Approved unanimously.

• Ethan Kusmin, 120 Summer Street, SE57-2537.  John Scagliarini motioned to approve as amended.  Approved unanimously.
• Center Hill Limited Partnership, SE57-2538.  Gerre Hooker motioned to approve as written.  Approved unanimously.
• John Donohue, 2 Massasoit Avenue, SE57-2513.  John Scagliarini motioned to approve as amended.  Approved unanimously


FIELD CHANGE:
• Robert Ankstitus, 125G Taylor Avenue, SE57-2521 – to allow 3.1 x 3.5 stairs off front of the side deck.
David Foster motioned to allow the field change.  Approved unanimously.

CERTIFICATE OF COMPLIANCE:
• Stephen Franzino, 56 Bay Shore Drive, SE57-2491 (addition and ss).  Gerre Hooker motioned to issue COC.  Approved unanimously.
• Emma Bachofner, 111 Manomet Avenue, SE57-73 (original seawall permit).  Gerre Hooker motioned to issue COC.  Approved unanimously.
• William Snow, 111 Manomet Avenue, SE57-1855 (septic upgrade, no as-built plan was filed with BOH, although BOH confirms system is in place).  Gerre Hooker motioned to issue COC.  Approved unanimously.
• Center Hill Ltd. Partnership, 64 Center Hill Road, SE57-1958 (stabilize coastal bank).  James Aimone motioned to issue COC.  Approved unanimously.
• Edwina Cahill, 64 & 74 Center Hill Road, SE57-878 (seawall construction).  Gerre Hooker motioned to issue COC.  Approved unanimously.
