MINUTES OF THE MEETING
March 15, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
David Foster was absent.

7:20 PM        Joseph Brennan, 5 Clifford Road, Parcel ID Nos. 041-000-016B-003 and 041-000-016B-002.  A Notice of Intent to construct a single family dwelling including amenities and utilities in the buffer zone and to construct a shed and seasonal dock within the wetland resource of the Eel River Pond.
Mark Flaherty of Flaherty & Stefani, Inc. and Bob Gray of Sabatia represented the applicant and explained the project.  Mr. Gray explained how he has come to the assessment that this area of the Eel River should be classified as a pond rather than river.  He showed DEP change map1st map, NCRS maps, USGS topographic map.  Various maps were presented.  He also submitted his report in the form of a letter dated March 15, 2011.  They said they they tossed a few tennis balls into the pond and they travelled to the sides as their was no observance of movement with the river flow.
Brooke Monroe supported the information and theory provided by Sabatia.

There was no public comment made
Gerre Hooker agreed with the pond assessment and motioned to approve the project with conditions.  Approved unanimously.

7:30 PM A. Ethan Kusmin, 120 Summer Street, Parcel ID No. 018-000-017-000.  A Notice of Intent to construct a one-story addition including a mud room addition, on the existing dwelling, in the buffer zone and riverfront area of Town Brook (aka Mill Pond).

The homeowner, Ethan Kusmin, represented himself and explained his project.  He asked for a waiver for work within the 35 ft. setback.  Staff reported her measurement to be 39 ft. to top of inland bank and, therefore, the work did not require a waiver request.
Mr. Kusmin agreed to removing the bank debris prior to construction and plantings would be provided at the top of bank as mitigation.
No public comment.
John Scagliarini motioned to approve with conditions including the mitigation.  Approved unanimously.

7:40 PM John Donahue, 2 Massasoit Avenue, Parcel ID No. 049-001-012A-001.  A Notice of Intent to extend the existing coastal stone revetment including the placement of approx. 100 ft. of steel sheeting into the coastal bank for the protection from ongoing erosion from adjacent property.
William Shaw of Associated Engineers of Plymouth represented the applicant and explained the project.  An agreement has been reached between the applicant and the beach Association.  Although the plan shows the fill on the entire length of the lot, only 80ft. is proposed at this time.  The sheeting has been eliminated.
No public comment.
James Aimone motioned to approve the project with conditions.  Approved unanimously.

ACTION ITEMS:

Bill Keohan of the Community Preservation Committee (CPC) spoke regarding the CR on the Nickerson property off Russell Mill Road.
Mr. Keohan explained that the CPC took an application for the Nickerson property, 30 acres.  They put an easement on the part of the property they wanted to keep in the family but would also allow access to the CR parcel.  Town would be asked to hold the CR and their would be a burden of responsibility on the town for monitoring.  The Wildlands Trust may also be asked to hold the CR.  Lee Hartmann also expanded the Town’s responsibility if they hold the CR.  Discussion ensued over the liability issue and Mr. Keohan noted that there is some protection to towns on recreation lands.  The Commission would soon see a draft of the Agreement.  No further action taken.
