MINUTES OF THE MEETING
January 4, 2011
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, January 4, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were: Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe, John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present. The Chairman, Evelyn Strawn was absent.

7:00 P.M. Administrative Business
7:30 P.M. Public Hearing Begin
The Commission welcomed Commissioner, Major David Foster, back from his tour of duty in Afghanistan.
7:30 PM Paul B. Reid, 27 Provincetown View Road, Parcel ID No. 049-002-118-000. A Request for Determination of Applicability to upgrade a septic system, remove an unused oil tank, loam and seed to stabilize, in the buffer zone of a coastal bank.
No presentation – No public comments.
James Aimone motioned to issue a negative determination. Approved unanimously.
7:30 PM Robert K. Connors, 96 and 98 Center Hill Road, Parcel ID Nos. 052-000-005-000; 052-000-006A-000. A Request for Determination of Applicability to upgrade a septic system and install a new well, in the buffer zone of the top of a coastal bank.
No presentation – No public comments.
Brooke Monroe motioned to issue a negative. Approved unanimously.
7:30 PM Carreau Family Land Trust, 531 Federal Furnace Road, Parcel ID No. 095-000-060-000; 095-000-062A-000. A Request for Determination of Applicability to repair and upgrade a septic system and construct an addition onto the office building, in the buffer zone of Saby’s Pond.
Anthony Esposito represented the applicant and explained the project.
Septic system has failed. Cesspool is currently serviced by one pipe and must be separated. New grease trap will be installed and a new line will also service the office and new addition. 84 leaching chambers will be installed.
Letter from Division of Fisheries and Wildlife was read into the record.
John Scagliarini motioned to issue a negative determination with a waiver that allows work within the 35 ft. no-touch zone. Approved unanimously.
Continued from November 9, 2010
7:40 PM John Donahue, 2 Massasoit Avenue, Parcel ID No. 049-001-012A-001. A Notice of Intent to extend the existing coastal stone revetment including the placement of approx. 100 ft. of steel sheeting into the coastal bank for the protection from ongoing erosion from adjacent property.
Bill Shaw, Associated Eng. Represented the applicant and explained the potential new project that will allow access from the association property to build a seawall to the property line and placement of the steel sheeting would be eliminated. Discussion with the Association was still in the works. Applicant requested a continuance.
Public comment:
Eileen M. Collins, 62 Cape Cod Avenue, commented that she went to Mashpee town hall and spoke to various agencies confirming that steel sheeting has not been used on the bank. Mr. Shaw disagreed with this statement. There was no further discussion.
John Scagliarini motioned to continue to February 1, 2011 at 7:40 PM. Approved unanimously.
7:50 PM Eric Gerstenberg & Christine Clancy-Gerstenberg, 84 Shore Drive, Parcel ID No. 050-001-041-000Z. A Notice of Intent to upgrade a septic system and construct an in-ground swimming pool with amenities including landscaping and fencing, in the buffer zone of the top of a coastal bank.
Brad Bertolo of JC Engineering represented the applicant and explained the project. He began with a description of the site: manicured lawn, runoff trench on the back yard perimeter, stone revetment built within the last 5 years.
A swimming pool and relocated septic system will be requested. A fence is being proposed within 25 of the top of the coastal bank and a waiver of the 35 ft. no touch setback is requested.
John Gately, of Shore Drive concern with zoning setbacks. Confirmed that pool is salt water.
Concern with activity in the pool that may affect their quality of life.
Discussion ensued over the use of the 35 ft. setback for a fence construction.
Public comment closed.
David Foster motioned to approve the project with conditions and issuing the variance that would allow work, as proposed, in the 35- ft. no-touch zone.. Paul Withington opposed.
Approved by a majority.
Other Business:
ACTION ITEMS:
Sign the Weston property (Map 88/Lot 25) Purchase and Sale Agreement. The Purchase and Sales Agreement was executed.
27 King Philip Road – J. Randolph Parker requests approval to start work. Applicant is requesting to commence work on stabilizing an eroding coastal bank with sand bags as soon as NOI is filed, but before the public hearing and Order of Conditions issued.
Jaime Aimone motioned to allow work to commence upon the filing of the Notice of Intent. Approved unanimously.
74 Center Hill Road (Map 52/Lot 4A-2)
Requesting to dump 3-5 ton stone in an eroded area caused by December 2011 blizzard.
Jaime Aimone motioned to issue the Emergency Permit. Discussion ensued over the use of stones. Approved unanimously.
Alec Petro (Saquish Beach)
Requesting to dump fill in an eroding dune. No action taken.
ORDERS OF CONDITIONS:

James Aimone motioned to approve the Order as amended. Approved unanimously.
